At present, China has implemented the Management Measures for Special Maintenance of Residential Buildings since February 1 2008, and the restrictions are effective. However, according to the regulations, the competent departments of construction (real estate) of the people's governments of municipalities directly under the central government, cities and counties may formulate local management measures according to local actual conditions.
For example, on September 17, 2020, the Housing and Construction Bureau of Haikou City issued the Administrative Measures for Special Maintenance of Residential Buildings in Haikou City (Draft for Comment) (hereinafter referred to as the Draft for Comment) for public consultation, which stipulated that:
1. The owners and construction units of newly-built houses shall deposit the first special maintenance according to the construction area of the property they own, and the amount of the first special maintenance per square meter of construction area is 60 yuan.
2. For the commercial housing that has been sold, the owner shall deposit the first special maintenance into the special maintenance account before handling the house check-in. Commercial housing or non-residential housing that has not been sold at the time of real estate registration shall be deposited by the construction unit as the owner with the first special maintenance fund. If the resettlement house belongs to commercial housing, it shall be deposited through consultation between the development and construction unit and the expropriated resettlement person; If there is no agreement, it shall be deposited by the expropriated person.
3. If the owner fails to deposit the first special maintenance according to the provisions of these Measures, the construction unit shall not deliver the house to the purchaser.
