1. The owners of commercial housing and non-residential housing shall deposit special housing maintenance funds according to the construction area of their own property, and the amount of the first special housing maintenance funds deposited per square meter of construction area is 5% to 8% of the local housing construction and installation project cost per square meter.
The competent departments of construction (real estate) of the people's governments of municipalities directly under the central government, cities and counties shall, according to local conditions, reasonably determine and announce the amount of the first-phase residential special maintenance fund deposited per square meter of construction area, and make timely adjustments.
2. For the sale of public housing, the special maintenance fund for housing shall be deposited in accordance with the following provisions: the owner shall deposit the special maintenance fund for housing according to the construction area of the property he owns, and the amount of the first special maintenance fund for housing per square meter of construction area shall be 2% of the local housing reform cost price. Units selling houses shall, in accordance with the proportion of multi-storey residential buildings and high-rise residential buildings of not less than 20% and 30% respectively, draw special maintenance funds from the houses.
Is it necessary to pay the maintenance fund?
Housing maintenance fund must be paid. It is the owner's obligation to pay the house maintenance fund before handing over the house. The way to pay the housing maintenance fund can be to deposit it in the special account of the housing maintenance fund, or ask the developer to collect it on his behalf.
The first and second paragraphs of Article 12 of the Measures for the Administration of Residential Special Maintenance Funds stipulate that commercial housing owners should deposit the first phase of residential special maintenance funds into the special account of residential special maintenance funds before going through the formalities of housing occupancy.
Owners who have sold public housing shall deposit the first phase of special maintenance funds for public housing into the special account for special maintenance funds for public housing or hand them over to the units selling houses to deposit them into the special account for special maintenance funds for public housing before going through the housing check-in formalities.
Article 13 stipulates that if a development and construction unit or a public housing sale unit fails to deposit the first special maintenance fund of the house in accordance with the provisions of this law, it shall not deliver the house to the purchaser.
