Article 12 of the Trial Measures for the Management of Road Traffic Accident Social Assistance Funds When one of the following circumstances occurs, the assistance fund shall advance the funeral expenses and part or all of the rescue expenses for the personal injury or death of the victim in the road traffic accident: (1) The rescue expenses exceed the liability limit of compulsory traffic insurance

; (2) The motor vehicle causing the accident did not participate in compulsory traffic insurance; (3) The motor vehicle fled after the accident.

If the victim's funeral expenses and part or all of the rescue expenses should be advanced by the relief fund according to law, the relief fund management agency in the place where the road traffic accident occurred shall advance the payment in a timely manner.

Legal objectivity: Trial Measures for the Management of Road Traffic Accident Social Assistance Funds Article 2 These Measures shall apply to the collection, use and management of road traffic accident social assistance funds.

The term "road traffic accident social assistance fund" (hereinafter referred to as the "relief fund") as mentioned in these Measures refers to the special social fund raised in accordance with the law to advance the funeral expenses and part or all of the rescue expenses of the victims of motor vehicle road traffic accidents.
