Regulations on the Promotion and Management of Rural Collective Economy in Xiangxi Tujia and Miao Autonomous Prefecture
Chapter I General Provisions Article 1 In order to promote the healthy development of rural collective economy, standardize the management of rural collective economic organizations, safeguard the legitimate rights and interests of rural collective economic organizations and their members, consolidate the achievements in tackling poverty, promote rural revitalization and realize common prosperity, these Regulations are formulated in accordance with the Rural Revitalization Law of People's Republic of China (PRC) and other relevant laws and regulations, and in combination with the actual situation of this state. Article 3 The term "rural collective economy" as mentioned in these Regulations refers to an economic form in which members of rural collective economic organizations use collectively owned resource elements to achieve common development through cooperation and joint efforts.

The term "rural collective economic organizations" as mentioned in these Regulations refers to the joint-stock economic cooperatives (economic cooperatives) of townships (towns, sub-district offices), joint-stock economic cooperatives (economic cooperatives) of villages (communities) and joint-stock economic cooperatives (economic cooperatives) of villagers' groups established according to law and registered by the administrative departments of agriculture and rural areas. Article 4 The development and management of rural collective economy shall follow the principles of government promotion, collective ownership, local conditions, democratic management and scientific development. Fifth Prefecture People's government is responsible for the organization and leadership of rural collective economic work.

County (city) people's government is responsible for the overall coordination, guidance, supervision and inspection of rural collective economic work.

The Township People's Government (street offices) is responsible for the guidance, service, supervision and management of rural collective economic work, and it is clear that specialized agencies and personnel undertake specific work.

Village (neighborhood) committees support and guide village (neighborhood) people to actively develop village (community) collective economy and provide production conditions for the development of rural collective economy. Sixth state and county (city) departments in charge of agriculture and rural areas are responsible for the industry management and guidance services of rural collective economy. Finance, development and reform, natural resources and planning, human resources and social security, rural revitalization, finance and insurance, taxation, commerce, science and technology, auditing, market supervision and other departments shall do a good job in promoting and managing the rural collective economy within their respective functions and duties. Seventh state and county (city) people's governments shall, in accordance with the relevant provisions of the state, commend and reward the units and individuals that have made remarkable achievements in guiding the construction of rural collective economic organizations and expanding the rural collective economy. Eighth to encourage, guide and support people's organizations, social organizations, enterprises, institutions and individuals and other social sectors to participate in rural collective economic promotion and management activities. Chapter II Promotion Article 9 The state and county (city) people's governments should strengthen policy support in finance, projects, land, talents, water, electricity, finance, insurance, taxation, e-commerce and science and technology, so as to promote the development of rural collective economy. The scope of rural collective assets includes:

(a) collectively owned land, forests, mountains, grasslands, wasteland, beaches and other resource assets;

(2) collectively owned houses, buildings, machinery and equipment, tools and appliances, agricultural infrastructure, stock assets, intangible assets and other operating assets held by collectively invested enterprises and other economic organizations;

(3) Non-operating assets such as education, science and technology, culture, health and sports that are collectively owned and used for public services;

(4) Assets formed by accepting government subsidies, tax relief, social donations, etc. ;

(5) Other assets owned by member collectives according to law, encourage rural collective economic organizations to revitalize the management right of rural collective assets in a low-risk and sustainable way, develop the property economy, service economy and resource economy, and cultivate and develop a new rural collective economy according to local conditions through contracting, leasing, shareholding, attracting investment or independent operation, so as to obtain stable income. Eleventh state and county (city) people's governments shall incorporate the development of rural collective economy into the national economic and social development plan, and include the funds for the development of rural collective economy in the fiscal budget at the same level.

State, county (city) financial departments shall arrange special funds to support the development and growth of rural collective economy by means of capital integration, first building and then making up, awarding instead of making up, cooperation between government and social capital, and government guiding funds. Twelfth state and county (city) people's governments and relevant departments shall support rural collective economic organizations to undertake construction projects to develop agriculture and rural economy. In addition to the projects that should be subject to tender according to laws and regulations and the projects supporting agriculture for which the superior has provisions on the use of financial funds, under the same conditions, a certain proportion of construction projects will be given priority according to procedures and implemented by rural collective economic organizations that meet professional conditions or economic entities with shares in rural collective economic organizations. Support rural collective economic organizations to independently or jointly develop and invest in the construction of agricultural industrialization bases and agricultural products processing enterprises, and give priority to infrastructure projects such as roads, water supply, power supply and gas supply.

Fixed assets formed by public welfare undertakings and infrastructure projects such as rural drinking water, small-scale irrigation, garbage disposal, cultural fitness, village group parking lot, photovoltaic power generation, rural (town) village (community) farmers' market invested by the state can be confirmed to the village, and managed by rural collective economic organizations in accordance with relevant state regulations, and the proceeds will be owned by them.
