Chapter I General Provisions Article 1 In order to serve Zhuhai's urban development goal of building a "core city on the west bank of the Pearl River Estuary, a new special zone of ecological civilization and a demonstration city of scientific development", we should standardize the old city reconstruction activities, further improve the urban functions, optimize the industrial structure, enhance the image of the city, highlight its characteristics, improve the living environment and promote the economical and intensive use of land, energy and resources. And promote sustainable economic and social development, in accordance with the provisions of relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to urban renewal activities within the administrative area of this Municipality.

The term "urban renewal" as mentioned in these Measures refers to the activities of transformation, reconstruction or demolition of urban built-up areas (including old industrial areas, old commercial areas, old office areas, old residential areas, villages in cities, etc.). ) In accordance with the procedures stipulated in the urban planning and these Measures:

(1) Dangerous houses are concentrated.

(2) Urban infrastructure and public service facilities need to be improved.

(three) the environment is harsh or there are major security risks.

(four) the existing land use, the use function of buildings or the utilization of resources and energy obviously do not meet the requirements of economic and social development, which affects the implementation of urban planning.

(five) the planning and design conditions of the "three old" (that is, the old industrial plant, the old town and the old village) transformation project have been approved.

(six) other circumstances in which urban renewal should be carried out according to law or with the approval of the municipal government. Article 3 The term "concentration of dangerous houses" as mentioned in Item 1, Paragraph 2, Article 2 of these Measures refers to the concentration of houses identified as dangerous houses or with other serious building quality and safety hazards by relevant institutions according to the standards for the identification of dangerous houses.

The "urban infrastructure and public service facilities need to be improved urgently" as stipulated in Item 2 of Paragraph 2 of Article 2 of these Measures refers to the serious shortage of urban infrastructure and public service facilities, and the implementation of urban infrastructure, public service facilities or other public interest projects with an independent land area of over 3,000 square meters according to the planning needs.

The "bad environment or major security risks" as stipulated in Item 3 of Paragraph 2 of Article 2 of these Measures mainly include the following situations:

(a) serious environmental pollution, serious lack of ventilation and lighting, not suitable for production and life.

(2) The fire escape and fire climbing surface do not conform to the relevant regulations, and there are serious fire hazards.

(3) Other major safety hazards, such as frequent water inflow, have been identified by relevant institutions.

The "existing land use, building use function or resource and energy utilization obviously does not meet the requirements of economic and social development and affects the implementation of urban planning" as stipulated in Item (4) of Paragraph 2 of Article 2 of these Measures, mainly including the following situations:

(a) major adjustments have taken place in the functional orientation of regional planning, and the existing land use and land use efficiency are inconsistent with the planning function, which affects the implementation of urban planning.

(two) belongs to the city banned and eliminated industries, energy consumption, water consumption, pollutant emissions seriously exceed the relevant national, provincial and municipal standards, or land use efficiency is low, affecting the implementation of urban planning, can be upgraded.

(three) other circumstances that seriously affect the implementation of the city's recent construction planning. Article 4 Urban renewal shall follow the principles of "scientific development, calm construction, planning guidance, diversified benefits, market operation, policy support, orderly management and steady progress" to ensure and promote the scientific development of cities. Article 5 Urban renewal shall conform to the overall plan for national economic and social development and obey the overall plan for urban and land use. Urban renewal shall implement the system of urban renewal unit planning and annual plan management.

Urban renewal unit planning is the basic basis for managing urban renewal activities.

The annual plan of urban renewal shall be incorporated into the annual implementation plan of the recent construction plan and the annual plan of land use. Article 6 Urban renewal can be implemented by the municipal, district government (administrative committee), land use right holders or other qualified units in accordance with relevant laws, regulations and these Measures. Article 7 The municipal and district governments (administrative committees) shall guarantee the funds for organizing the implementation of urban renewal and give appropriate financial support to urban renewal projects.

Urban renewal involves the construction of infrastructure and public service facilities, and the corresponding project funds shall be arranged from the special funds for urban construction. Urban renewal involves government investment projects, which shall be implemented in accordance with the relevant provisions on the management of government investment projects. Eighth city urban renewal work leading group is responsible for leading the city's urban renewal work, and making decisions on major issues involved in the city's urban renewal work.

The Municipal Urban Renewal Management Office is the permanent working department of the city's urban renewal work, responsible for coordinating the planning and management of urban renewal, and organizing, coordinating and supervising the city's urban renewal work.

The competent department of urban renewal of the district government (CMC) shall, in accordance with the provisions of these measures, perform the relevant duties of urban renewal management within its jurisdiction. Article 9 The district governments (administrative committees) shall organize land consolidation for urban renewal within their respective jurisdictions, organize renovation and renewal projects within their respective jurisdictions and the municipal government to determine the implementation of demolition and renewal projects implemented by them, and coordinate the implementation of renovation and other demolition and renewal projects.

The municipal land and resources department is responsible for formulating land management policies related to urban renewal according to law, and is responsible for the transfer, recovery and acquisition of land use rights in the process of urban renewal.

The municipal competent department of urban and rural planning is responsible for formulating relevant planning and management policies for urban renewal according to law, coordinating urban renewal planning and management, formulating relevant technical specifications for urban renewal, and organizing the preparation of municipal urban renewal special plans.

The municipal development and reform department is responsible for formulating industrial guidance policies related to urban renewal, and making overall arrangements for the annual funds for urban renewal involving government investment.

The municipal finance department is responsible for allocating funds for urban renewal projects as planned.

Other relevant functional departments of the municipal government and the relevant functional departments of the district government (Administrative Committee) shall perform the relevant duties of urban renewal management in accordance with the provisions of these Measures, and provide services and implement management for urban renewal activities within their respective responsibilities according to law.
