Legal basis: Trial Measures for the Management of Social Assistance Fund for Road Traffic Accidents

Article 2 These Measures shall apply to the collection, use and management of social assistance funds for road traffic accidents. The social relief fund for road traffic accidents as mentioned in these Measures (hereinafter referred to as the relief fund) refers to the social special fund raised according to law to advance the funeral expenses of the victims of motor vehicle road traffic accidents and part or all of the rescue expenses.

Article 13 Under any of the circumstances listed in Article 12 of these Measures, the traffic administrative department of the public security organ shall notify the relief fund management institution in writing within 3 working days if it is necessary for the relief fund to advance part or all of the relief expenses.

Article 14 After rescuing a victim, a medical institution may apply to the relief fund management institution to advance the unpaid rescue expenses, and provide relevant certification materials.

Article 15 After receiving the advance notice from the traffic administrative department of the public security organ and the application and related materials from the medical institution for advance payment of outstanding rescue expenses, the relief fund management institution shall, within five working days, review the following contents according to the relevant provisions of these Measures, the Guidelines for Clinical Diagnosis and Treatment of Injured Persons in Road Traffic Accidents and the charging standards set by the local price department, and inform the traffic administrative department of the public security organ and the medical institution handling road traffic accidents in writing of the audit results: (1) Whether it belongs to the advance payment from the relief fund specified in Article 12 of these Measures; (two) whether the rescue expenses are true and reasonable; (3) Other contents that the relief fund management institution deems necessary to be audited. In line with the requirements of advance payment, the relief fund management institution shall transfer the relevant expenses to the account of the medical institution.
