Legal analysis: the road traffic accident rescue fund does not need the victim to pay back the money. The relief fund is a new system stipulated in Article 17 of the Road Traffic Safety Law of the People's Republic of China. This system is a supplement to the compulsory liability insurance for motor vehicle traffic accidents (hereinafter referred to as "compulsory insurance"). The purpose is to ensure that victims can get timely assistance or appropriate compensation through the rescue fund when they can't get compensation according to the compulsory insurance system and the infringer.

Legal basis: Article 17 of the Road Traffic Safety Law of the People's Republic of China. The state implements the compulsory third-party liability insurance system for motor vehicles and establishes a social assistance fund for road traffic accidents. Specific measures shall be formulated by the State Council.
