In order to strengthen the management of social organizations in this Municipality and give full play to the positive role of social organizations in socialist modernization, the following provisions are formulated according to the spirit of the Notice on Strictly Controlling the Establishment of National Organizations issued by the Central Committee and the State Council and forwarded by the General Office of the Central Committee and the General Office of the State Council, combined with the actual situation of this Municipality.
First, the scope of social organizations.
1. The term "social organizations" as mentioned in these Provisions refers to social and academic organizations such as societies, associations, federations, research institutes, foundations and centers voluntarily organized by units or individuals throughout the city. Social and economic organizations, social welfare organizations, literary and artistic organizations, sports organizations and other social organizations.
2. The social organizations mentioned in these Provisions do not include people's organizations such as trade unions, Communist Youth League, women's federations, youth federations, federations of industry and commerce, Taiwan Province Compatriots' Association, Federation of Returned Overseas Chinese, Association for Science and Technology, Federation of Social Sciences, Beijing Branch of All-China Sports Federation, religious organizations such as Buddhist Association and Catholic Patriotic Association, and organizations of government organs, armed forces, enterprises and institutions.
Second, the principles of the formation of social organizations.
1. The establishment of city-wide social organizations shall abide by the provisions of relevant laws and regulations, adhere to the principles of voluntariness, equality and mutual benefit of units or individuals, and the leading members shall be democratically elected or produced through full consultation. It is not allowed to be forcibly formed by administrative measures and administrative means.
2, where the provisions of the scope of management of social organizations, not listed as national administrative or public institutions, indefinite levels, personnel are not included in the administrative and career preparation, funds are not included in the national financial budget and final accounts.
The number of full-time staff of social organizations shall be determined by the examination and approval unit. The government encourages and supports the solution of personnel problems through recruitment. Its salary can be implemented according to the standards of national institutions, and the money is paid from the income such as membership fees.
Measures for the administration of capital revenue and expenditure shall be determined by the competent business department in conjunction with the Municipal Finance Bureau.
3. A large category can only set up a social group with the same industry nature.
4, social organizations are not allowed to engage in profit-making production, management and other enterprise activities, have been engaged in enterprise activities, should be decoupled from the enterprise.
5. Non-citywide social organizations shall not be preceded by the words "Beijing" and "Capital".
Third, the necessary conditions for social groups.
1, there should be articles of association that do not conflict with laws and regulations. The articles of association include the name, purpose, tasks, organization, membership and procedures, obligations and rights of members, generation and term of office of leaders, payment of membership fees and fund management, meeting place, etc. The articles of association shall be confirmed by the competent department of the municipal party committee and municipal government.
2. There must be a certain number of members, and each member should be representative.
3, there must be a business director of the municipal party committee and the municipal government, and the centralized department is responsible for business guidance.
4. Establish a lean and permanent office.
5. There should be appropriate sources of funds and fixed office space and other necessary working conditions.
Four, the application and approval procedures for the establishment of social organizations.
1, the establishment of social organizations in this Municipality shall be negotiated by the same system and industry according to the current management system. Formed by the unit, first reported to the municipal party committee, municipal government business director, centralized department for examination and approval, and then apply to the civil affairs department for registration. The civil affairs department shall grant registration and issue a registration certificate before it can be established.
Social academic groups, which belong to natural sciences, shall be reviewed by the Municipal Association for Science and Technology and approved by the Municipal Science and Technology Commission; Belonging to philosophy and social sciences, it shall be audited by the Municipal Social Science Association and reported to the Propaganda Department of the Municipal Party Committee for approval.
Social and economic organizations, including various trade associations, professional associations and various economic and technical consulting institutions, shall be examined and approved by the Municipal Economic Commission or other business directors and centralized departments of the municipal government.
Social welfare organizations shall be examined and approved by the Civil Affairs Bureau.
Literary and art working groups, sports working groups and social groups in education and health shall be examined and approved by the Cultural and Educational Office of the municipal government.
Financial and other social organizations shall be examined and approved by the Municipal Planning Commission or other business directors and centralized departments of the municipal government.
Social organizations such as culture, art, academic research, social welfare and friendship initiated by citizens alone or jointly shall be examined and approved by the Civil Affairs Bureau.
2. The examination and approval and registration authorities shall conduct strict examination in accordance with the spirit of the notice of the Central Committee and the State Council Municipality on strictly controlling the establishment of national organizations and these Provisions. Anyone who does not meet the requirements shall not be approved or registered.
Five, the review of the original social groups.
1, to review the city-wide social organizations established before the promulgation of these Provisions.
2. The main contents of the review: whether it is necessary to continue to exist; Whether it meets the conditions of social organizations in this Municipality; Whether the actual activity content is consistent with its purpose.
3, the organization of the review by the Civil Affairs Bureau is responsible for, with the original approval authority. After examination, if it is really necessary to continue to exist and meet the conditions of social organizations in this Municipality, the Civil Affairs Bureau will renew the Social Organization Registration Certificate in accordance with the Trial Measures for the Registration of Social Organizations in Beijing; Those who do not meet the conditions will not be registered.
4, the central government to determine the people's organizations and religious groups included in the administrative and career preparation, by the municipal organization committee office is responsible for the audit. Social organizations that are not determined by the central government to be included in the administrative and career preparation and included in the financial budget and final accounts shall be gradually solved by the Municipal Organization Committee and the Municipal Finance Bureau according to the specific circumstances.
5. The deadline for review is1March 3, 9871day. Social organizations that fail to report to the Civil Affairs Bureau for review within the time limit are automatically dissolved.
6. Organization and management of social organizations.
The city-wide social organizations shall be determined by the examination and approval authorities as their competent business units, guide and manage them in accordance with the articles of association, and supervise their activities.
Seven, news reports of social groups.
Newspapers, periodicals, radio, television and other news organizations must be verified by the Civil Affairs Bureau when reporting the newly established city-wide social groups (including advertisements). Without verification, it shall not be reported.
Eight, the formation of regional social groups.
The establishment of regional social organizations in districts and counties should also be strictly controlled, and the specific examination and approval measures shall be formulated by the district and county party committees and district and county governments with reference to these provisions.
Nine, the specific issues in the implementation of these Provisions shall be interpreted by the Municipal Civil Affairs Bureau.
X. These Provisions shall come into force as of 1986 1 February1day.
