According to different legal forms, securities investment funds can be divided into contractual funds and corporate funds. At present, funds in China are all contractual funds; Corporate funds are represented by American investment companies.

Trust-type investment fund: namely, contractual investment fund refers to the investment fund established by fund sponsors through issuing fund shares according to the fund contracts concluded with fund managers and fund custodians.

1. Contract fund is a Class I fund established according to the fund contract.

In China, contractual funds are established according to the fund contract signed by the fund manager and the fund custodian. Fund investors become fund share holders and parties to fund contracts after obtaining fund shares, and enjoy rights and assume obligations according to law.

2. Corporate funds are legally joint-stock investment companies with independent legal personality.

Corporate funds are established according to the articles of association of the fund company. Fund investors are shareholders of the fund company, enjoy the rights of shareholders, and share the investment income according to the shares they hold, and bear limited responsibilities.

The establishment of a partnership fund is to register a new partnership, usually a limited partnership.

According to the provisions of the Partnership Law, the number of shareholders in a limited partnership at this time should not be called shareholders, but should be called partners. The number of partners is 20 to 50. And a limited partnership must have at least one general partner, that is, GP.

The name of a limited partnership enterprise shall be marked with the words "limited partnership".
