The Road Relief Fund is a social relief fund for road traffic accidents in Jiangsu Province. The People's Government of Jiangsu Province attaches great importance to the preparations for the implementation of the social relief fund for road traffic accidents, organizes relevant departments to carefully plan the preparations for the implementation of the relief fund, and creates conditions to promote the smooth implementation of the relief fund in Jiangsu Province as soon as possible, so as to truly do a good job of benefiting the country and the people. With the consent of the provincial people's government, the general office of the provincial government officially forwarded the "Implementation Measures for the Management of Social Assistance Fund for Road Traffic Accidents in Jiangsu Province" (hereinafter referred to as the "Management Measures") formulated by the Provincial Department of Finance, Jiangsu Insurance Regulatory Bureau and other six bureaus, which shall come into force as of the date of promulgation. The social relief fund for road traffic accidents (hereinafter referred to as the relief fund) refers to the social special fund raised according to law to pay for funeral expenses, part or all of the rescue expenses and help families with special difficulties caused by traffic accidents. When the traffic accident victims, their close relatives and the compensation obligor are unable to pay or exceed the payment standard of the accident vehicle underwriting insurance company, the rescue fund shall advance the rescue expenses and funeral expenses in advance, and after the rescue fund advances, they shall claim compensation from the person responsible for the motor vehicle road traffic accident according to law. The relevant units, the victims or their heirs have the obligation to assist the relief fund in recovery. The relief object of the relief fund refers to the victims caused by motor vehicle road traffic accidents except the insured vehicle personnel and the insured.

The Administrative Measures stipulates the advance scope of the relief fund: under any of the following circumstances, the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents shall be paid in advance by the relief fund, and the relief fund management institution shall have the right to recover from the person responsible for the road traffic accident:

(a) the cost of rescue exceeds the limit of compulsory insurance liability;

(two) the motor vehicle did not participate in compulsory insurance;

(3) A motor vehicle escapes after an accident;

(four) other circumstances that need assistance, including the inability of the responsible person in traffic accident compensation to compensate, which causes difficulties for the victim's family and really needs assistance. If a traffic accident victim needs a relief fund to pay part or all of the relief expenses, the traffic administrative department of the public security organ shall notify the relief fund manager in writing within three working days, and the traffic accident victim or his close relatives shall submit a relief application to the relief fund manager's acceptance outlet at the place where the accident occurred in time with relevant certification materials. If the identity of the victim cannot be determined or the victim and his close relatives cannot apply for assistance, and the medical institution or funeral institution has paid the medical rescue expenses or the funeral expenses for death, the medical institution or funeral institution may apply for assistance on its behalf. After receiving the application and related materials, the relief fund manager shall, within five working days, review the application according to the relevant provisions of these Measures, the guidelines for clinical diagnosis and treatment of road traffic accident victims and the charging standards formulated by the local price department. In line with the first payment or relief conditions, the relief fund manager will transfer the relevant expenses to the account of the medical funeral institution. Do not meet the conditions for advance payment or assistance, not to advance assistance, and explain the reasons to the applicant.

Second, the promotion process:

Basic procedures for the relief fund to advance the relief expenses: If the relief fund needs to advance part or all of the relief expenses, the traffic administrative department of the public security organ shall notify the relief fund management institution in writing within 3 working days. After receiving the advance notice from the traffic administrative department of the public security organ and the application and related materials for medical institutions to advance outstanding rescue expenses, the relief fund management institution shall conduct an audit within five working days. In line with the advance conditions, the relief fund management institution shall transfer the relevant expenses to the account of the medical institution.

Legal basis:

It should be emphasized that Article 75 of the Road Traffic Safety Law stipulates: "Medical institutions shall promptly rescue the injured in traffic accidents, and shall not delay the treatment because the rescue expenses are not paid in time."

Basic procedures for the relief fund to advance funeral expenses: If the relief fund is needed to advance funeral expenses, the relatives of the victims shall submit a written application for advance payment to the relief fund management institution on the basis of the Notice on Disposal of Corpse issued by the traffic management department of the public security organ handling road traffic accidents and their identity certificate. After receiving the application for advance payment of funeral expenses and relevant supporting materials, the relief fund management institution shall pay the funeral expenses in advance in accordance with relevant standards within three working days, and notify the traffic management department of the public security organ in writing to deal with road traffic accidents. The ownerless or unrecognizable remains shall be handled by the public security department in accordance with relevant regulations.
