The maintenance fund needs to be paid in two installments.

The maintenance fund belongs to the owner and is used for the maintenance of the building and its ancillary facilities. When the balance of the special maintenance fund in the owner's account is less than 30% of the first deposit amount, the owner shall repay it according to this ratio. The use of the maintenance fund must be decided by the owners' meeting and can be used for the maintenance and renewal of elevators, roofs and external walls. Management and use of maintenance funds;

1. Establishment of maintenance fund: the developer of residential quarters collects maintenance fund from the owners in a specified proportion when handing over the house, and submits it to the owners' meeting or the property management committee in the property management area for management;

2. Storage of maintenance fund: the maintenance fund shall be earmarked and deposited in the designated bank account, and shall not be misappropriated;

3. The scope of use of the maintenance fund: it is mainly used for the maintenance, renewal and transformation of public parts and facilities in the community and the replacement of large equipment;

4. Procedures for the use of maintenance funds: the owners' assembly or the property management committee shall put forward a use plan according to the needs and implement it after the resolution of the owners' assembly is passed;

5. Supervision and management of the maintenance fund: the owner has the right to supervise the revenue and expenditure of the maintenance fund, and the property service enterprise or other management unit shall regularly announce the revenue and expenditure and balance of the maintenance fund to the owner.

To sum up, the maintenance fund belongs to the owner. Mainly used for the maintenance of buildings and their ancillary facilities. When the account balance is insufficient, it needs to be paid to the specified proportion. Measures for the administration of residential special maintenance funds

Article 17

If the balance of the special maintenance fund of the owner's household residence is less than 30% of the initial deposit, it shall be renewed in time.

If the owners' meeting is established, the renewal plan shall be decided by the owners' meeting.

If the owners' meeting is not established, the specific management measures for the renewal of the lease shall be formulated by the construction (real estate) department of the people's government of the municipality, city or county jointly with the finance department at the same level.

Article 278

The following matters shall be decided by the Owner * * *:

(a) to formulate and amend the rules of procedure of the owners' congress;

(2) Formulating and amending management regulations;

(nine) other major matters related to the management rights of * * * and * * *.

The owners * * * agree that the decision shall be passed by the owners who account for more than two-thirds of the exclusive area and more than two-thirds of the total number. Decisions on matters specified in Items 6 to 8 of the preceding paragraph shall be subject to the consent of the owners and more than 3/4 of the voters who participate in voting on the exclusive part. Other matters specified in the preceding paragraph shall be decided with the consent of more than half of the owners voting, and with the consent of more than half of the owners voting.

Article 28 1

The maintenance fund of the building and its ancillary facilities belongs to the owner. With the consent of the owner, it can be used for local maintenance, renewal and transformation of elevators, roofs, external walls and barrier-free facilities. The collection and use of maintenance funds for buildings and their ancillary facilities shall be announced regularly.

In case of emergency, if the building and its ancillary facilities need to be repaired, the owners' assembly or the owners' committee may apply for the maintenance funds of the building and its ancillary facilities according to law.
