The rescue fund unit may claim compensation from the person responsible for the accident or the insurance company.

1, road traffic accident social assistance fund refers to the social special fund raised according to law to advance the funeral expenses and part or all of the rescue expenses of the victims in motor vehicle road traffic accidents.

2, under any of the following circumstances, the relief fund to advance the funeral expenses of road traffic accident victims, part or all of the rescue expenses:

(1) The rescue expenses exceed the compulsory insurance liability limit;

(two) the motor vehicle did not participate in compulsory insurance;

(3) A motor vehicle escapes after an accident.

3, the source of relief funds:

(1) Funds drawn according to a certain proportion of the premium of compulsory motor vehicle traffic accident liability insurance (hereinafter referred to as compulsory insurance);

(2) Financial subsidies given by local governments according to the amount of business tax paid by insurance companies for compulsory insurance;

(three) fines for motor vehicle owners and managers who fail to apply for compulsory insurance in accordance with the regulations;

(four) the results of the rescue fund;

(five) the funds recovered by the relief fund management institution from the person responsible for the motor vehicle road traffic accident according to law;

(6) social donations;

(7) Other funds.

"Trial Measures for the Management of Social Relief Funds for Road Traffic Accidents" Article 24 After the relief fund management institution advances the rescue expenses and funeral expenses according to these measures, it shall claim compensation from the person responsible for motor vehicle road traffic accidents according to law.

In the case of Item (3) of Article 12 of these Measures, if the relief fund advances the funeral expenses or part or all of the rescue expenses, after the road traffic accident case is detected, the traffic management department of the public security organ handling the road traffic accident shall promptly notify the relief fund management institution.

The relevant units, the victims or their heirs have the obligation to assist the relief fund management institution in making recovery.
