Legal basis: measures to identify charitable organizations
Article 1 In order to standardize the identification of charitable organizations, these Measures are formulated in accordance with the provisions of the Charity Law of the People's Republic of China (hereinafter referred to as the Charity Law).
Article 2 These Measures shall apply to non-profit organizations, such as foundations, social organizations and social service institutions, which were established before the promulgation of the Charity Law, to apply for recognition as charitable organizations.
Article 3 The civil affairs departments of the people's governments at or above the county level shall identify registered foundations, social organizations and social service institutions as charitable organizations.
Article 4 Foundations, social organizations and social service institutions applying for recognition as charitable organizations shall meet the following conditions:
(1) Having the corresponding conditions for the registration of social organizations as legal persons at the time of application;
(2) Taking charitable activities as its purpose, and its business scope conforms to the provisions of Article 3 of the Charity Law; The annual expenditure and management expenses of charitable activities in the previous year at the time of application conform to the provisions of the civil affairs department of the State Council on charitable organizations;
(3) Not for profit, and all the proceeds and operating balances are used for charitable purposes as stipulated in the articles of association; Property and its fruits are not distributed among the promoters, donors or members of the organization; There are provisions in the articles of association to transfer the surplus property to other charitable organizations with the same or similar purposes;
(4) Having a sound financial system and a reasonable salary system;
(5) Other conditions stipulated by laws and administrative regulations.
