Article 83 Party and state functionaries or persons entrusted with the management and operation of state-owned property embezzle, steal, defraud or illegally occupy public property by other means by taking advantage of their positions, and if the circumstances are relatively minor, they shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
those who embezzle party dues, social security funds and funds for disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and epidemic prevention shall be given a heavier or heavier punishment in accordance with the provisions of the preceding paragraph until they are expelled from the party.
article 84 if the party and state organs, state-owned enterprises (companies), institutions and people's organizations privately distribute state-owned assets to individuals in the name of units in violation of relevant regulations, the main responsible persons and other directly responsible personnel shall be investigated for their responsibilities, and if the circumstances are minor, they shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
if the disciplinary organ, the administrative law enforcement organ or the judicial organ, in violation of relevant regulations, collectively distributes the confiscated property that should be turned over to the state to individuals in the name of the unit, the persons who are mainly responsible and other persons who are directly responsible shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 85 Party and state functionaries or other personnel engaged in public affairs who take advantage of their positions to extort other people's property or illegally accept other people's property to seek benefits for others shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
if the persons listed in the preceding paragraph take advantage of their positions and illegally accept other people's property in disguise to seek benefits for others, if the circumstances are serious, they will be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party, kept on probation or expelled from the party.
those who have caused great losses to the interests of the state, the collective and the people due to accepting bribes will be given a heavier or heavier punishment until they are expelled from the party.
If you make things difficult for the other party to get revenge for the attempted claim for property and cause losses to the other party, you will be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
article 86 any party and state functionary or any other official who, in violation of the relevant provisions, accepts property or kickbacks or service fees in various names in economic exchanges, which are owned by individuals, shall be regarded as accepting bribes and dealt with in accordance with the provisions of article 85 of these regulations.
article 87 any party and state functionary or any other official who, by taking advantage of his position, seeks illegitimate interests for the trustee through the actions of other party and state functionaries, or accepts or illegally accepts the trustee's property in disguise shall be dealt with in accordance with the provisions of article 85 of these regulations.
article 88 party and state functionaries who, after retiring (leaving), use the convenience formed by their original powers or status to seek benefits for the trustee through the actions of the party and state functionaries in their posts, and I ask for or illegally accept or illegally accept the property of the trustee in disguise, shall be dealt with in accordance with the provisions of article 85 of these regulations.
article 89 if the party and state organs, state-owned enterprises (companies), institutions and people's organizations ask for or illegally accept other people's property, or illegally accept it in disguise, and seek benefits for others, those who are mainly responsible and other persons who are directly responsible shall be investigated for their responsibilities, and if the circumstances are serious, they shall be given a warning, a serious warning or be dismissed from their posts within the party; If the circumstances are serious, he shall be given probation or expelled from the party.
if the units listed in the preceding paragraph secretly accept kickbacks and service fees in various names outside the account during economic exchanges, they shall be regarded as accepting bribes, and the persons who are mainly responsible and other persons who are directly responsible shall be dealt with in accordance with the provisions of the preceding paragraph.
In case of making things difficult for subordinate units and customers to retaliate because of the attempted claim for property, and causing losses to the other party, the main responsible person and other directly responsible personnel shall be given a warning or severe warning; If it causes great losses, it shall be given the punishment of revoking the post within the party or staying in the party for observation; Causing heavy losses, be expelled from the party.
those who privately divide the property obtained or illegally accepted or illegally accepted in disguised form in partnership shall be treated as bribery according to the amount of personal income and its role, and in accordance with the provisions of Article 85 of these regulations.
article 9. in order to seek illegitimate interests, giving property to party and state workers or other personnel engaged in public affairs, if the circumstances are minor, giving a warning or severe warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
whoever, in violation of relevant regulations in economic exchanges, gives kickbacks or service fees in the form of property or in various names to party and state staff or other personnel engaged in public affairs shall be dealt with in accordance with the provisions of the preceding paragraph.
if bribery causes great losses to the interests of the state, the collective and the people, it shall be given a heavier or heavier punishment in accordance with the provisions of this article, until it is expelled from the party.
Article 91 Whoever gives property to the Party and state organs, state-owned enterprises (companies), institutions and people's organizations for the purpose of seeking illegitimate interests, or gives kickbacks or service charges in various names in violation of relevant regulations in economic exchanges, if the circumstances are minor, shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
if a unit commits any of the acts listed in the preceding paragraph, the persons who are mainly responsible and other persons who are directly responsible shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 92 Whoever introduces bribes to party and state functionaries or other personnel engaged in public affairs shall be given a warning or severe warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
article 93 if a unit pays bribes for seeking illegitimate interests, or gives party and state staff or other personnel engaged in public affairs kickbacks or service fees in various names in violation of relevant regulations, the main responsible person and other directly responsible personnel shall be investigated for their responsibilities, and if the circumstances are serious, they shall be given a warning, a serious warning or be dismissed from their posts within the party; If the circumstances are serious, he shall be given probation or expelled from the party. If the illegal income obtained from bribery is owned by individuals, it shall be handled in accordance with the provisions of Article 9 of these regulations.
Article 94 Party and state functionaries or persons entrusted with the management and operation of state-owned property who, by taking advantage of their positions, misappropriate public funds for personal use, engage in illegal activities, or engage in profit-making activities, or fail to pay them back for more than three months, if the circumstances are relatively minor, shall be given a warning or a serious warning; If the circumstances are serious, he shall be dismissed from his post within the party or be placed on probation; If the circumstances are serious, he shall be expelled from the party.
those who misappropriate party dues, social security funds and funds for disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief and epidemic prevention shall be given a heavier or heavier punishment in accordance with the provisions of the preceding paragraph until they are expelled from the party.
misappropriation of public funds for personal use for less than three months, but the amount is relatively large, shall be handled in accordance with the provisions of this article.
article 95 if party member, a rural party organization, a community party organization, a villagers' committee, a community residents' committee and other grass-roots organizations, engages in the following official duties, takes advantage of his position, illegally occupies public property, misappropriates public funds, extorts other people's property or illegally accepts other people's property in disguised form to seek benefits for others, he shall be dealt with according to the provisions of articles 83, 94 and 85 of these regulations, respectively:
(1) Party dues.
(2) the management of social donations to public welfare undertakings;
(3) the operation and management of state-owned land;
(4) management of land expropriation compensation fees;
(5) collecting and paying taxes;
(6) related to family planning, household registration and conscription;
(7) assisting the people's government in other administrative work;
(8) to engage in the party's discipline inspection, organization (personnel), publicity and other work in accordance with the party's internal laws and regulations.
article 96 if the property or expenditure of party and state functionaries or other personnel engaged in public affairs obviously exceeds their legitimate income, and the difference is large, they may be ordered to explain the source. I cannot explain the source legally, and the difference is regarded as illegal income, and they shall be given a serious warning or dismissed from their posts within the party; If the circumstances are serious, he shall be given probation or expelled from the party.
party and state employees who conceal overseas deposits in violation of relevant regulations shall be dealt with in accordance with the provisions of the preceding paragraph.
