If the main sewer pipe in the bathroom leaks, the property management company should be held responsible.
Because the main sewer is used by the public, the property management company is responsible for the maintenance and repair of public facilities, and the maintenance costs incurred are borne by the maintenance fund.
According to Article 942 of the "People's Republic of China and Civil Code", the property service provider shall properly repair, maintain, clean, green and operate and manage the property owners in the property service area in accordance with the agreement and the nature of use of the property***
Some departments maintain basic order in the property service area and take reasonable measures to protect the personal and property safety of owners.
For violations of relevant laws and regulations on public security, environmental protection, fire protection, etc. within the property service area, the property service provider shall promptly take reasonable measures to stop, report to the relevant administrative departments and assist in handling the violations.
Extended information: Article 4 of the "Measures for the Administration of the Use of Public Maintenance Funds" The maintenance fund is specially used for maintenance projects after the warranty period of facilities and equipment in residential areas has expired.
The term "facilities and equipment for residential use" as mentioned in these Measures refers to the relevant parts, facilities and equipment of the house that are jointly owned and used by all or part of the property owners in the residential building or property management area.
Projects with exclusive facilities for use in occupied areas shall be stipulated in the Property Management Convention in accordance with the building area allocation principles of this city's housing companies.
