The term "restoration and management of mine ecological environment" as mentioned in these Regulations refers to the activities of restoring and managing mountain vegetation damage and land excavation, collapse, occupation, pollution and soil erosion caused by mining, and adopting engineering and biological measures such as vegetation restoration and land reclamation. Article 3 The restoration and management of mine ecological environment should be combined with development and utilization, and the principles of scientific planning, adapting measures to local conditions, economic feasibility, comprehensive management and whoever develops will restore and whoever destroys will manage will be followed, so as to realize the coordinated development of resource utilization, development and construction and ecological protection. Article 4 The Municipal People's Government shall strengthen the unified leadership, supervision and inspection of mine ecological environment restoration and management. The people's governments of counties (including county-level cities and districts, the same below) are responsible for the specific organization, implementation, supervision and management of mine ecological environment restoration and management within their respective administrative areas.
The municipal and county people's governments shall guarantee the capital investment in the restoration and management of mine ecological environment, and establish and improve the assessment and reward mechanism. Article 5 The municipal and county people's governments shall establish a working mechanism of mine ecological environment restoration and governance with government leading, graded responsibility, departmental linkage and social participation, and the administrative departments of land and resources shall be specifically responsible for the coordination of mine ecological environment restoration and governance.
The relevant administrative departments and institutions of the people's governments of cities and counties, such as land and resources, forestry, water affairs, finance, production safety supervision, environmental protection, animal husbandry, development and reform, economy and informatization, civil affairs, agriculture, construction and transportation, shall, within their respective functions and duties, do a good job in the restoration and management of mine ecological environment. Township (including town) people's governments and sub-district offices shall cooperate with relevant administrative departments to do a good job in the restoration and management of mine ecological environment. Article 6 If the exploitation of mineral resources causes damage to the mine ecological environment, the mining right holder shall be responsible for the restoration and treatment, and the treatment expenses shall be included in the production cost. Due to historical reasons, it is impossible to determine the responsible person or the mines lost by the responsible person. The county people's government shall organize the relevant administrative departments to put forward expert opinions. Article 7 In accordance with the principle of "whoever invests benefits", support and preferential measures shall be taken to attract social investment to restore and control the mine ecological environment that the responsible person cannot be determined or lost due to historical reasons.

Article 8 The municipal and county people's governments shall strengthen the publicity and education of mine ecological environment restoration and management, enhance the public's awareness of mine ecological environment restoration and management, and encourage and support the research and innovation of mine ecological environment restoration and management technology. The municipal and county people's governments shall commend or reward the units and individuals that have made outstanding contributions to the restoration and management of mine ecological environment. Chapter II Restoration and Governance Planning Article 9 The administrative department of land and resources of the Municipal People's Government shall, jointly with the administrative departments of forestry, water affairs, finance, production safety supervision, environmental protection, animal husbandry, development and reform, economy and informatization, civil affairs, agriculture, construction and transportation, formulate a plan for the restoration and governance of mine ecological environment in the whole city, which shall be announced to the public after being approved by the Municipal People's Government and incorporated into the national economic and social development plan of the whole city. Tenth mine ecological environment restoration and management planning shall include the following main contents:
(a) the basic situation of mine ecological environment;
(two) the objectives and tasks of restoring governance;
(3) Priority areas and key projects;
(4) Safeguard measures;
(5) Other contents that should be included. Eleventh mine ecological environment restoration and management planning is compiled every five years, and the approved mine ecological environment restoration and management planning shall not be adjusted without authorization. If adjustment is really necessary, it shall be reported to the original approval authority for approval. Article 12 The county people's government shall, according to the municipal plan for the restoration and management of mine ecological environment, prepare an annual plan for the restoration and management of mine ecological environment, which shall be announced to the public after approval by the municipal people's government, and shall be organized and implemented by the county people's government. Thirteenth mine ecological environment restoration and management of the annual plan shall include the following main contents:
(a) the specific recovery and management methods and scope of the mine;
(two) the standard and time limit for the restoration of governance;
(3) Measures to restore governance;
(4) Other contents that should be included. Fourteenth mine ecological environment restoration and management plans and annual plans shall be included in the catalogue of major administrative decisions of the government at the same level, and the major administrative decision-making procedures of the government shall be fulfilled. Fifteenth city and county people's governments shall organize the relevant administrative departments to conduct an investigation on the destruction of mine ecological environment within their respective administrative areas every five years, and announce the results of the investigation to the public as the basis for formulating the next five-year plan.
The administrative department of land and resources of the people's government at the county level shall entrust a professional institution with relevant qualifications to dynamically monitor the destruction and management of mine ecological environment within its administrative area, form a monitoring report, and report to the people's government at the same level and the administrative department of land and resources at a higher level.
