Chapter I General Provisions

Article 1 In order to further develop and standardize the social endowment insurance system for urban and rural residents in Guangdong Province, and safeguard the legitimate rights and interests of urban and rural residents to participate in social endowment insurance and enjoy social endowment insurance benefits, according to the Social Insurance Law of People's Republic of China (PRC), Guiding Opinions of the State Council on Launching the Pilot Project of New Rural Social Endowment Insurance (Guo Fa [2009] No.32) and Guiding Opinions of the State Council on Launching the Pilot Project of Urban Social Endowment Insurance (Guo Fa [206544).

The social endowment insurance system for rural residents in Nijo Castle is based on the basic principle of "basic protection, wide coverage, flexibility and sustainability", and adheres to the correspondence between rights and obligations, the combination of government-led promotion and voluntary participation of residents. Article 3 The social endowment insurance for urban and rural residents shall adopt the system mode of combining social pooling with individual accounts. Individual contributions, collective subsidies, government subsidies and social donations. The treatment form of combining basic pension with personal account pension.

Article 4 Rural residents and urban non-employed residents who have reached the age of 16 (excluding students at school), have household registration in Guangdong Province, and do not meet the requirements for participating in the basic old-age insurance for urban workers may voluntarily participate in the social old-age insurance for urban and rural residents at their domicile.

Chapter II Fund Raising

Article 5 The social endowment insurance fund for urban and rural residents is mainly composed of individual contributions, collective subsidies, government subsidies and social donations.

Article 6 Individual contributions. Persons who participate in social endowment insurance for urban and rural residents (hereinafter referred to as the insured) shall pay endowment insurance premiums in accordance with regulations. The payment standard is set to ten grades of 120 yuan, 240 yuan, 360 yuan, 480 yuan, 600 yuan, 960 yuan, 1200 yuan, 1800 yuan, 2,400 yuan and 3,600 yuan per year. The insured can choose one of the grades independently, and pay annually, quarterly or monthly. In a natural year, the insured can only choose one payment method and payment standard.

The provincial people's government adjusts the payment standard in a timely manner according to the economic development and the income growth of urban and rural residents. The people's governments at the municipal level may add payment grades according to local conditions and determine the payment methods.

Article 7 Collective subsidies. Conditional village (neighborhood) collective economic organizations shall give payment subsidies to the insured. The payment subsidy standard shall be determined by the village (neighborhood) people's committee convening the village (neighborhood) people's meeting or the village (neighborhood) people's representative meeting. The highest standard of collective subsidy shall not exceed the amount of my contribution.

Article 8 Government Subsidies

(a) the people's governments at all levels shall give subsidies to the insured payment, and the subsidy standard shall not be less than 30 yuan per person per year. The required funds shall be borne by the cities, counties (cities, districts) in the Pearl River Delta region, the eastern and western wings of northern Guangdong and mountainous areas (including Jiangmen enping city, Kaiping and Taishan, of which 70% of the subsidy standard is given by the provincial finance, the same below) by the provinces, cities and counties (cities, districts), and the provincial financial burden shall be borne by people at all levels. (3) If the insured pays for more than 15 years, the basic pension in 3 yuan will be increased every month for every more than 15 years, and the required funds will be borne by the people's government of the overall planning area. Conditional areas can improve the payment subsidy standard and basic pension standard according to local conditions, and the increased funds will be borne by themselves.

The provincial people's government shall adjust the payment subsidy standard and basic pension standard in a timely manner according to the unified deployment of the state, and relevant matters shall be notified separately.

(4) The people's government in the overall planning area shall reduce or exempt part or all of the minimum standard old-age insurance premium for the urban and rural poor groups such as severely disabled people, mentally and intellectually disabled people. The specific measures shall be formulated by the people's government of the overall planning area, and the required funds shall be borne by the people's government of the overall planning area.

Article 9 Social donation. Encourage all sectors of society to donate to subsidize urban and rural residents with difficulties to participate in insurance. Through government praise, tax incentives and other measures, and strive to broaden the financing channels. The specific implementation measures shall be formulated separately by the Provincial Department of Human Resources and Social Security in conjunction with relevant functional departments.

Tenth urban and rural residents social endowment insurance fee collection agencies determined by the local municipal people's government. The collection agency shall regularly inform the insured and the village (neighborhood) committees about the payment of the insured.

Chapter III Personal Accounts

Eleventh social insurance agencies to the insured person's citizenship number for its registration, for each insured person to establish a lifelong record of the old-age insurance personal account. Individual contributions, collective subsidies, government subsidies and other sources of payment subsidies are all included in personal accounts.

Article 12 The amount stored in individual accounts shall bear interest every year with reference to the one-year RMB deposit rate of financial institutions published by the People's Bank of China.

Thirteenth insured persons shall not surrender in advance or withdraw the amount of personal account.

Article 14 Reservation, transfer and inheritance of individual accounts.

(a) if the insured person interrupts payment, his personal account shall be kept by the social insurance agency, and the interest shall be calculated continuously. Those who pay back in the future do not enjoy the government's payment subsidies, and the accumulated amount of personal account storage and payment period are calculated.

(2) If the insured person transfers the household registration across the overall planning area, he can transfer the social endowment insurance relationship between urban and rural residents and the amount of personal account storage to the new insured place, and continue to pay the insurance premium and enjoy relevant treatment according to the provisions of the new insured place. Those who have received pension benefits on a monthly basis will no longer transfer the pension insurance relationship and still receive pension benefits in the same place.

(three) the insured person to settle abroad but still retain the nationality of China people, their personal accounts shall be retained, and when they meet the statutory conditions, they shall enjoy the corresponding pension insurance benefits in accordance with the regulations. If the insured person goes abroad to settle down after receiving the pension insurance benefits, he can continue to receive the pension insurance benefits. Persons who have settled abroad and lost their People's Republic of China (PRC) nationality have been insured or received pension insurance benefits in accordance with relevant regulations, and shall terminate the pension insurance relationship and stop receiving monthly pension insurance benefits. Upon my written application, I can receive the balance of my personal account except the principal and interest of government subsidy funds at one time.

(4) After the death of the insured, in addition to the principal and interest of government subsidy funds, the amount or balance stored in his personal account shall be paid to his legal heir or testamentary successor and legator in one lump sum. The principal and interest of government subsidies will be included in the social endowment insurance fund for urban and rural residents and continue to pay pensions for other insured persons. If there are no legal heirs or testamentary heirs or legatees, all the savings in individual accounts will be included in the social endowment insurance fund for urban and rural residents.

Chapter IV Enjoyment of Interests

Fifteenth urban and rural residents' pension benefits are composed of basic pension and personal account pension, which are paid for life. The basic pension standard is 65 yuan per person per month. The monthly calculation and payment standard of personal account pension is the amount stored in personal account divided by the number of calculation and payment months. The number of months is calculated according to the Decision of the State Council on Improving the Basic Old-age Insurance System for Enterprise Employees (Guo Fa [2005] No.38). After the individual account is released, the people's government of the overall planning area is responsible for continuing to issue individual account pensions according to the original standards.

Sixteenth insured persons who meet one of the following conditions can receive a monthly pension.

(1) When the new rural social endowment insurance in Guangdong Province (hereinafter referred to as the new rural social endowment insurance) and the urban social endowment insurance (hereinafter referred to as the urban social endowment insurance) were implemented locally, people who have reached the age of 60 and have not enjoyed the basic old-age insurance benefits for employees and other old-age benefits stipulated by the state can receive the basic pension on a monthly basis without paying fees.

(two) the insured who participated in the new rural insurance or urban residential insurance shall pay the fees according to the fixed number of years stipulated in the original participation system, and can receive a monthly pension after reaching the age of 60.

(three) the insured payment has reached 15, over 60 years of age, can receive a monthly pension.

(four) if the insured person is over 60 years old but the accumulated payment period has not reached the prescribed payment period, he can continue to pay the fees year by year and enjoy the corresponding government payment subsidies. If the annual payment to the age of 65 does not reach the prescribed payment period, you can pay the old-age insurance premium in one lump sum to the prescribed payment period and receive the pension on a monthly basis, but the one-time payment does not enjoy the government's payment subsidy.

(5) If the insured person has reached the age of 60 and the accumulated payment period has not reached the prescribed payment period, if he does not continue to pay the fee year by year or pay the prescribed payment period, he will not pay the basic pension, but can apply for a personal account pension on a monthly basis until the payment is completed.

Seventeenth after the death of the insured, funeral subsidies can be issued. The funeral subsidy standard is determined by the people's government of the overall planning area, and the required funds are borne by the people's government of the overall planning area.

Article 18 After the death of a person who receives a pension according to regulations, the pension shall be stopped from the month following his death. Their immediate family members shall, within 1 month after their death, go to the local social insurance agency to go through the formalities of stopping the payment of pensions. Pensions that have not been paid in time should be returned in time.

Nineteenth social insurance agencies should pay pensions in full and on time. Pensions are socialized on a monthly basis.

Twentieth social insurance agencies and village (neighborhood) committees regularly publicize the pension qualifications of insured persons in administrative villages or communities, and accept supervision by the masses.

Chapter V Fund Management and Supervision

Twenty-first urban and rural residents' social endowment insurance fund is earmarked, and no organization or individual may occupy or misappropriate it.

Twenty-second urban and rural residents' social endowment insurance fund shall be managed by pilot counties (cities, districts), and the management level shall be gradually improved. Where conditions permit, municipal administration can be directly implemented.

Article 23 The social endowment insurance fund for urban and rural residents shall be fully incorporated into the financial special account of the social security fund, and shall be managed by two lines of revenue and expenditure, with separate accounting, so as to maintain and increase the value in accordance with relevant regulations.

Article 24 The accounting and financial management of the social endowment insurance fund for urban and rural residents shall refer to the Interim Measures for the Financial Management of the New Rural Social Endowment Insurance Fund promulgated by the Ministry of Finance and Ministry of Human Resources and Social Security, and be temporarily implemented according to the Accounting System and Financial System of the Social Insurance Fund promulgated by the Ministry of Finance and the former Ministry of Labor and Social Security.

Article 25 The human resources and social security department shall earnestly perform the supervision duties of the social endowment insurance fund for urban and rural residents, formulate and improve various business management rules and regulations, standardize business processes, establish and improve the internal control system and fund audit system, monitor and regularly check the fund raising, disbursement and distribution, and regularly disclose the fund raising and payment information, so as to be open and transparent and accept social supervision. Finance, supervision and auditing departments shall supervise according to their respective responsibilities to ensure the safety of the fund.

Twenty-sixth social insurance agencies shall regularly announce to the public the participation of urban and rural residents in social endowment insurance and the income, expenditure, balance and income of the fund.

Twenty-seventh urban and rural social endowment insurance fund into the fiscal budget at the same level, shall not be charged from the urban and rural social endowment insurance fund.

Article 28 Whoever conceals, transfers, misappropriates or misappropriates the endowment insurance fund for urban and rural residents shall be ordered to return it within a time limit by the administrative department of social insurance, the financial department and the auditing department. If there are illegal gains, the illegal gains shall be confiscated. The directly responsible person in charge and other directly responsible personnel shall be punished according to law. Twenty-ninth by fraud, forgery and other means to defraud the pension insurance benefits of urban and rural residents, the social insurance administrative department shall order it to be returned within a time limit and dealt with according to law. Chapter VI Institutional Cohesion

Article 30 The original new rural insurance and urban residence insurance insured persons shall be uniformly incorporated into the social endowment insurance for urban and rural residents, and their new rural insurance or urban residence insurance personal account funds shall be incorporated into the personal account of urban and rural residents' endowment insurance, and the payment period of new rural insurance or urban residence insurance shall be accumulated into the payment period of urban and rural residents' endowment insurance. Those who have not reached the conditions for receiving a monthly pension shall continue to pay. Persons who have received pensions on a monthly basis in accordance with the provisions of the new rural insurance or urban residential insurance shall continue to receive pensions on a monthly basis in accordance with these measures.

Article 31 in accordance with the relevant provisions of the state, do a good job in linking these measures with the basic old-age insurance system for employees of urban enterprises, the minimum living guarantee for urban and rural residents, the five guarantees in rural areas, special care and other related systems.

Thirty-second soldiers who participate in social endowment insurance for urban and rural residents after retiring from active service shall go through the transfer and connection procedures in accordance with relevant state regulations.

Chapter VII Organization and Management of Services

Thirty-third people's governments at all levels should incorporate the social endowment insurance for urban and rural residents into the national economic and social development plan, establish and improve the working system, strengthen publicity and launch work, and implement the responsibility system for work objectives.

Thirty-fourth human resources and social security departments take the lead in the management of social endowment insurance for urban and rural residents, and do a good job in overall planning, formulation of policy standards, review and summary of the draft fund budget and final accounts, and comprehensive coordination with relevant departments. The financial department is responsible for the budget and disbursement of government subsidy funds, the management of funds deposited in financial special accounts, the financial supervision of fund revenue and expenditure and management, and the review of the draft budget and final accounts of funds. The public security department is responsible for providing the basic information of urban and rural residents' household registration and the death, migration and cancellation of household registration. The civil affairs department is responsible for providing the identity information of length of military service, retired soldiers, low-income personnel and dead cremators. Development and reform, auditing, supervision, disabled persons' federations and other units shall, in accordance with their respective responsibilities, do a good job in related work.

Thirty-fifth localities should improve the handling system of social endowment insurance for urban and rural residents, and implement various handling businesses of social endowment insurance for urban and rural residents.

Article 36 Social insurance agencies shall do a good job in the registration of social endowment insurance for urban and rural residents, the records of personal rights and interests, the payment of social insurance benefits, and the preparation of the draft budget and final accounts of the fund, provide services such as social endowment insurance policy and business consultation, personal information inquiry, payment and check of records of enjoying old-age insurance benefits for urban and rural residents, and establish insurance files for the insured and keep them properly for a long time.

Article 37 The government should purchase services and choose financial institutions that can provide safe and convenient services for urban and rural residents to pay fees and benefits on their behalf.

Article 38 Establish and improve the unified information management system of urban and rural residents' social endowment insurance in the province, incorporate it into the construction of social security information management system ("Golden Insurance Project"), and share information resources with other citizens' information management systems. Vigorously promote social security cards to facilitate the insured to pay by credit card, receive benefits and inquire about their own insurance information.

Chapter VIII Supplementary Provisions

Article 39 These Measures shall be implemented as of 2013110/October 65438. The Notice on Printing and Distributing the Implementation Measures for the Pilot Project of New Rural Social Endowment Insurance in Guangdong Province (Yue Fu [2009]124) and the Notice on Printing and Distributing the Implementation Measures for the Pilot Project of Social Endowment Insurance for Urban Residents in Guangdong Province (Yue Fu [2009]1No.) shall be abolished at the same time.
