1. According to the Measures for the Administration of Special Maintenance Funds for Residential Buildings, both developers and buyers shall pay the property maintenance fund when signing the house sales contract. During the prophase property management, the developer shall deposit the property maintenance fund into financial institutions in the name of the owners' committee and set up a special account, and no one may use it.

Second, after the establishment of the owners' committee, the developer will hand over the property maintenance fund to the owners' committee, which will entrust the property management unit to manage it, which will be used exclusively for property maintenance and shall not be used for other purposes.

Third, the public * * * maintenance fund refers to the maintenance fund for public * * * parts and facilities and equipment of residential buildings in accordance with the Measures for the Administration of Maintenance Funds for Facilities and Equipment Used in Residential Buildings promulgated by the Ministry of Construction (Jian Jian Fa [1998] No.213).
