According to the actual situation of the autonomous prefecture, these regulations are formulated.
Article 2 These Regulations shall apply to the construction, management and protection of internal water projects in autonomous prefectures.
The term "water projects" as mentioned in these regulations refers to various water-related projects and their ancillary facilities that develop, utilize, control, allocate, conserve and protect water resources within the autonomous prefecture.
Article 3 The people's governments of autonomous prefectures and counties shall strengthen leadership over the construction, management and protection of water projects, incorporate water projects into national economic and social development plans, and increase capital investment.
Article 4 The water administrative departments of the people's governments of autonomous prefectures and counties are responsible for the unified management and supervision of water projects, and relevant departments at the same level shall do a good job in the management of water projects in accordance with their respective responsibilities.
Township (town) water management agencies are responsible for the management and services of water projects within their respective administrative areas.
Article 5 The people's governments of autonomous prefectures and counties shall formulate preferential policies to encourage units and individuals to construct water projects through sole proprietorship, joint venture, cooperation, etc., adhere to the principle of whoever invests, who benefits, and protect the legitimate rights and interests of investment operators.
Article 6: Any unit or individual has the obligation to protect water projects, and has the right to stop, report and accuse any behavior that encroaches on or damages water projects.
Article 7 The people's governments of autonomous prefectures and counties shall commend and reward units and individuals who have made outstanding achievements in the construction, management and protection of water projects.
Chapter 2 Planning and Construction Article 8 Water projects constructed in autonomous prefectures shall comply with river basin and regional comprehensive plans.
Article 9 The survey, design, construction and supervision of key national investment construction and other important water projects shall be undertaken by units with corresponding qualifications.
Article 10: Autonomous prefectures implement a consent system for water project construction planning.
The water project construction unit shall apply for a water project construction planning consent letter from the river basin management agency or the water administrative department at or above the county level.
The construction of water projects must be reviewed and approved by relevant departments before construction can begin.
Article 11 Water engineering projects constructed in autonomous prefectures shall be constructed in accordance with the approved design plans.
The water administrative department shall strengthen the management and supervision of water project construction.
When the water engineering construction project is completed and accepted, the water administrative department shall participate.
Article 12 The construction of small-scale water projects in rural areas adheres to the principles of government support, private assistance, and self-construction and self-management.
Autonomous prefecture and county water administrative departments should provide guidance and services.
Article 13: For water projects in autonomous prefectures, management and protection methods should be clarified and management and protection responsibilities should be implemented during the construction stage.
Article 14: Autonomous prefectures implement a water project property rights registration system, and water project rights holders shall apply for property rights registration to the water administrative department.
After the property rights of water projects invested by the state are registered, the water administrative department shall submit them to the state-owned assets management agency for filing.
Chapter 3 Management and Protection Article 15 Water projects in autonomous prefectures shall be subject to a combination of unified management and hierarchical management.
For water projects invested by the state or mainly constructed with state investment, the people's governments at or above the county level shall specify management agencies and implement management personnel as needed.
For water projects constructed by rural collective economic organizations mainly through investment and labor, the management and maintenance methods shall be clearly defined and the management personnel shall be assigned, and the township (town) people's governments shall report them to the county water administrative department for filing.
For water projects invested and constructed by other units or individuals, the investor shall specify the management unit and management personnel and report them to the county water administrative department for filing.
Article 16 The main responsibilities of the water project management agency: (1) Promote and implement relevant laws, regulations and these regulations; (2) Formulate management systems and implement operating procedures; (3) Formulate dispatch operation plans and emergency response plans; (4) Observation
Record the operation status of water projects, establish files, and report relevant information; (5) Manage and maintain water projects, apply for registration and safety appraisal of water projects; (6) Do a good job in safety production, soil and water conservation, comprehensive management, etc. of water projects
; (7) Assist in mediating, investigating and handling water disputes.
Article 17: The public welfare part of public welfare water projects and quasi-public welfare water projects in autonomous prefectures, their operation and management personnel's salaries and repair and maintenance expenses, etc., shall be included in the fiscal budget of the same level.
For commercial water projects and the operating part of quasi-public welfare water projects, the wages of operation and management personnel, repair and maintenance costs, renovation costs, etc. shall be borne by the owners, managers or operators of the water projects.
Article 18 Water project management personnel shall participate in training organized by relevant departments of the people's government at or above the county level, and only after passing the assessment can they engage in water project management work.
Article 19 The people's governments of autonomous prefectures and counties shall set up public security agencies for key water projects to be responsible for the public security management of water projects.
Article 20 The use of water engineering waters for shipping must be approved by the shipping administrative department.
The shipping administrative department shall seek the opinions of the water administrative department before approval.
Article 21 The people's governments of autonomous prefectures and counties shall delineate the management and protection scope of water projects, set up signs, and publicize them.
