According to China's "Measures for the Management of Maintenance Funds for Facilities and Equipment in Residential Areas * * * *", when selling commercial houses, the buyer and the seller shall sign an agreement on payment of maintenance funds. Property buyers shall pay the maintenance fund to the selling unit according to the proportion of 2%-5.2% of the purchase price.
If it is the maintenance fund collected by the selling unit, it belongs to all owners and is not included in the residential sales income. The collection ratio of maintenance funds shall be determined by the real estate departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
1. The purchaser shall pay the housing maintenance fund in the first installment according to 2.5% of the construction area cost of multi-storey residential buildings and 3% of the construction area cost of high-rise residential buildings.
2. The house seller shall pay the house maintenance fund at one time at 3% of the construction area cost of multi-storey houses and 4% of the construction area cost of high-rise houses.
3. If the house is occupied or leased by the development unit, it shall be paid in accordance with the construction area of the occupied or leased house and the provisions of Item 1 and Item 2 of this paragraph.
