Article 64 of the Criminal Law stipulates that "the property illegally obtained by criminals shall be recovered or ordered to make restitution". Article 10 of the Supreme People's Court's "Several Provisions on the Execution of Criminal Judgments Involving Property" is even more clear, and the people's court shall recover the stolen money and its income together. If the person subjected to execution invests in or buys a house with illicit money, the people's court shall recover the obtained property and its income. If the person subjected to execution invests in or purchases a house with stolen money and other lawful property, the people's court shall recover the share of the resulting property corresponding to the stolen money and its income.
At the same time, the trust law also stipulates that the premise of the effective establishment of a trust is that the property is legal and the purpose is legal. According to the provisions of the trust law, trust acts that violate laws, regulations and social interests, as well as trusts established with illegal property, are invalid; When a trust is established according to a contract or will, if the contract or will is invalid, the trust cannot be established accordingly; If the trust is invalid or revoked, it will not have the legal effect of separation and transfer of trust property, so it does not have the independence of trust property.
