1, energy-saving benefit sharing type

During the project period, the types of contracts that users share energy-saving benefits with energy-saving service companies. Investment in energy-saving renovation projects shall be borne by the energy-saving service company or solely by the energy-saving service company according to the agreement between the energy-saving service company and the users. After the completion of the project construction, both parties will share the energy-saving benefits according to the proportion agreed in the contract after confirming the energy-saving amount.

After the end of the project contract, the ownership of energy-saving equipment will be handed over to the user free of charge, and all the energy-saving benefits generated in the future will be owned by the user. Energy-saving benefit sharing is a model type strongly supported by our government. In order to reduce the payment risk, users can provide various payment guarantees for energy-saving benefits to energy-saving service companies.

2. Energy cost trusteeship type

The user entrusts the energy-saving service company to invest in the energy-saving transformation and operation management of the energy system, and submits the energy cost of the energy system to the energy-saving service company for management according to the agreement of both parties. The energy cost saved by the system belongs to the contract type of the energy-saving service company. After the end of the project contract, the energy-saving equipment transformed by the energy-saving company will be handed over to the user free of charge, and all the energy-saving benefits generated in the future will be owned by the user.

3. Energy-saving guarantee type

The type of contract in which the user invests and the energy-saving service company provides energy-saving services to users and promises to ensure the energy-saving benefits of the project. After the implementation of the project, the user will pay the service fee to the energy-saving service company in one lump sum or in installments after both parties confirm that the promised energy-saving benefits are achieved. If the promised energy-saving benefits are not achieved, the difference shall be borne by the energy-saving service company.

The energy-saving quantity guarantee contract is applicable to energy-saving projects with short implementation period and fast payment of energy-saving benefits, and generally a fixed energy-saving quantity price is agreed in the contract.

4. Types of financial leasing

Financing companies invest in energy-saving equipment and services of energy-saving service companies and lease them to users. According to the agreement, users are charged rental fees regularly. The energy-saving service company is responsible for transforming the user's energy system, and calculating and verifying the energy-saving amount during the contract period to ensure the energy-saving effect. After the end of the project contract, the energy-saving equipment will be handed over to the users free of charge by the financing company, and all the energy-saving benefits generated in the future will be owned by the users.

5. Mixed type

A contract type formed by any combination of the above four basic types. Only energy-saving benefit-sharing contracts can apply for financial and tax benefits of national contract energy management, and energy-saving service contracts with energy-saving benefit-sharing should be signed according to the reference contracts provided in the annex of technical general rules for energy management of contracts.

The key to implementation

The key elements of energy management contract include energy consumption status diagnosis, energy consumption benchmark determination, energy-saving measures, quantified energy-saving targets, energy-saving benefit sharing methods, measurement and verification schemes, etc. These elements also need to be determined in writing through the contract with the owner. Energy-using units and energy-saving service companies shall confirm each other, and determine the energy consumption benchmark according to the energy consumption status of energy-using units or energy-using equipment and links in a certain period of time when implementing the contract energy management project.

The determination, measurement and verification of energy consumption benchmark can be entrusted to a third party organization recognized by both parties to the contract for supervision and audit. Under the premise of meeting the same demand or achieving the same goal, it is the premise for energy-saving service companies to gain profits by implementing contract energy management and reducing the energy consumption of energy-using units or energy-using equipment and links relative to the energy consumption benchmark.
