First, the administrative departments of medical security at all levels should exercise the discretion of administrative punishment according to the implementation rules, which should be based on facts. The types and extent of administrative punishment should be adapted to the facts, nature, circumstances and social harm of the illegal act, and to the level of economic and social development of the place where the illegal act occurred. For illegal acts with the same or similar illegal facts, nature, circumstances and social harmful consequences, the types and scope of administrative punishment in the same administrative area should be basically the same.

Second, the medical insurance bureaus of all districts and cities should establish and improve the supervision system for regulating the discretion of administrative punishment of medical insurance funds, and strengthen the supervision and guidance on the exercise of discretion by the medical insurance administrative departments within their respective administrative areas through collective discussion of administrative punishment, review of the legality of administrative punishment decisions, evaluation of administrative law enforcement files, handling of administrative law enforcement complaints and reports, and publicity of administrative punishment results. If it is found that the discretion of administrative punishment is illegal or improper, it shall be corrected in time.

Third, the medical insurance bureaus of all districts and cities should increase the publicity of the implementation rules, guide the agencies, designated medical institutions and insured persons to consciously know and abide by the law, timely expose and summarize typical cases of administrative punishment, strengthen warning education, and maintain the normal operation of medical insurance funds and medical and health order. If there is any problem in the implementation, please report it to the Fund Supervision Department of the Provincial Bureau in time.
