In order to implement the Opinions of the State Council on Accelerating the Transformation of shantytowns (Guo Fa [2013] No.25), further intensify the transformation of shanty towns in the whole province, focus on improving the living conditions of residents in shanty towns, and accelerate the construction of new urbanization with people as the core, we hereby put forward the following implementation opinions.

I. General requirements

(1) guiding ideology. Guided by Deng Xiaoping Theory, Theory of Three Represents and Scientific Outlook on Development, with improving people's livelihood as the starting point and the foothold, in accordance with the principles of government leading, market operation and mass participation, we will adhere to the requirements of energy and land saving, environmental protection and green and low-carbon development, strengthen overall planning, publicity and guidance, and improve supporting policies and measures. Combine the transformation of shanty towns with the expansion and upgrading of central cities in eastern, western and eastern Guangdong, urban renewal, "three old" transformation and land consolidation, focus on promoting the transformation of resource-exhausted cities and shanty towns in areas where state-owned industrial and mining shanty towns and overseas Chinese farms are not concentrated, and give priority to renovation projects with large contiguous scale, difficult living conditions, incomplete basic housing functions, poor seismic performance of houses, serious structural and fire safety hazards and urgent needs of the masses.

(2) objectives and tasks. From 20 14 to 20 17, there were about138,000 shanty towns in the whole province, including 74,000 urban shanty towns, 46,000 state-owned industrial and mining shanty towns and 80,000 dangerous houses in overseas Chinese farms. Second, the scope of transformation, applicable objects and construction standards

(1) The scope of transformation.

1. Urban shanty towns. Refers to the urban planning area with simple structural houses, high building density, long service life, poor housing quality, many hidden dangers in building safety, imperfect use functions and incomplete supporting facilities, including the transformation of centralized shanty towns, non-centralized shanty towns and urban villages. On the basis of accelerating the transformation of centralized urban shanty towns, all localities can incorporate other non-centralized shantytown transformation, urban renewal and urban village transformation into the scope of urban shantytown transformation. Housing demolition and renovation projects implemented due to urban road expansion, historical block protection, cultural relics repair, etc. are not included in the scope of urban shantytown renovation. The specific scope of the transformation of urban shanty towns is reasonably determined by the local and county (city, district) governments in combination with the actual situation in the region.

2. State-owned industrial and mining shantytowns. Refers to the construction on state-owned land, which is managed by state-owned, state-controlled and collective industrial and mining enterprises. There are many houses with simple structure, high building density, long service life, poor housing quality, many hidden dangers in building safety, imperfect use functions and incomplete supporting facilities, with more than 20 households. The state-owned industrial and mining shanty towns located in the urban planning area are unified into the scope of urban shantytown transformation. Railway, steel, nonferrous metals, gold, salt and other state-owned industrial and mining shanty towns. In accordance with the principle of territoriality, it will be incorporated into the planning of shantytown renovation around the country, and will be organized and implemented by municipal and county (city, district) governments at all levels. Relevant departments at the provincial level should strengthen supervision and guidance, and relevant enterprises should actively cooperate.

3. Renovation of dangerous houses in overseas Chinese farms. All localities should unify the renovation of dilapidated houses in overseas Chinese farms that have not returned overseas Chinese or newly returned overseas Chinese into the scope of central subsidy support for the renovation of dilapidated houses in state-owned reclamation areas, and accelerate the organization and implementation of the renovation; It is necessary to carry out the renovation work of leaking households in the renovation of dilapidated houses in state-owned reclamation areas, continue to improve the construction of supporting infrastructure, optimize the layout, and promote industrial development and the construction of small towns on farms. The specific scope of the renovation of dilapidated buildings in overseas Chinese farms shall be implemented in accordance with the Opinions of the General Office of the People's Government of Guangdong Province on Further Promoting the Reform and Development of Overseas Chinese Farms (No.4 of Guangdong Government Office [2013]) and the Notice on Printing and Distributing the Implementation Plan for the Renovation of Dangerous Buildings in Overseas Chinese Farms in Guangdong Province (No.54 of Guangdong Government Office [2012]). All localities should carefully verify the new number of dangerous houses in overseas Chinese farms and bring them into the scope of transformation from 20 16 to 20 17 years.

4. Renovation of shanty towns in state-owned forest areas. The task of transforming shanty towns in state-owned forest areas has been basically completed, and eligible workers with housing difficulties in grass-roots units such as forestry workstations, nature reserves and state-owned nurseries outside state-owned forest areas have been included in the local urban housing security system as a whole.

(2) Applicable objects.

Take the residents who are living in shanty towns and voluntarily participating in the unified organization and transformation of the local government as the applicable object, mainly including urban residents in shanty towns (including villagers in villages in cities), employees of state-owned industrial and mining enterprises (including retirees) and employees of overseas Chinese farms (including non-returned overseas Chinese and newly returned overseas Chinese). Specific targets are determined by local and county (city, district) governments in light of local conditions.

(3) Construction standards.

In principle, the standard of apartment size for newly-built resettlement houses shall be implemented in accordance with the Notice of the Ministry of Housing and Urban-Rural Development and other five departments on Forwarding the Guiding Opinions of the Ministry of Housing and Urban-Rural Development on Promoting the Transformation of Cities and State-owned Industrial, Mining and Shantytowns (Guangdong Jianbao [2010] No.48), with small and medium-sized apartments of about 60 square meters as the main ones. The specific standards are determined by local governments themselves, and the governments of counties (cities, districts) combine local conditions.

Third, the transformation model.

(1) Comprehensive development and contiguous construction. For urban shanty towns that are scattered, difficult to transform and have high operating cost of a single project, they can be integrated with other urban shanty towns, dilapidated houses, urban renewal and urban village reconstruction projects nearby, and unified planning, overall construction, contiguous development and systematic transformation can be implemented.

(2) Executive-led, market operation. For shantytown renovation projects with market operation conditions, local governments can set the financial strength, qualification grade and enterprise credit of real estate development enterprises participating in shantytown renovation according to regulations, and determine the development enterprises through public bidding, auction and listing. At the same time, according to the principle of capital preservation and meager profit, the project development profit is limited, and the development enterprises are supervised to build resettlement houses and supporting projects in strict accordance with relevant regulations and standards.

(3) The government implements cooperation with enterprises. The local government is responsible for the overall organization and implementation of transformation projects such as state-owned industrial and mining shanty towns that do not have market-oriented operation conditions. All relevant units, state-owned industrial and mining enterprises and employees should actively cooperate to do a good job in the implementation of construction land, fund raising and policy propaganda.

Fourth, raise funds through multiple channels.

The funds for shantytown renovation and construction are raised through various channels, such as government start-up, market operation, and financing from all parties, mainly in the form of "eight points", that is, a little application from the central government, a little provincial subsidy, a little city and county financing, a little bank loan, a little enterprise solution, a little individual financing, a little policy reduction and exemption, and other support.

(1) Increase government input. The provincial finance supports the transformation of provincial state-owned industrial and mining shanty towns according to the subsidy standard of 1 10,000 yuan per household. For the provincial-level state-owned industrial and mining shantytown renovation projects that the central government increases subsidies, the provincial finance will increase subsidies accordingly. According to the actual situation of the transformation of state-owned industrial and mining shanty towns at the provincial level, the provincial finance gives subsidies to the public infrastructure construction of the transformation projects. Listed county (city, district) governments at all levels should increase capital investment, arrange shantytown renovation funds from urban maintenance and construction tax, urban public utilities surcharge, urban infrastructure supporting fees, land transfer income and other channels, and arrange a certain proportion of funds from the state-owned capital operating budget for shantytown renovation of state-owned industrial and mining enterprises. The land transfer income collected from shantytown renovation projects should be given priority for shantytown renovation and related infrastructure construction. According to the specific conditions of financing, construction methods and repayment sources of renovation projects, on the basis of granting loans with land use rights and mortgage guarantee of projects under construction, we will explore new models of loan granting and guarantee and innovate credit financial products. Encourage financial institutions to appropriately tilt to shantytown renovation projects in the arrangement of credit funds for real estate development, and give priority to ensuring the demand for credit funds for eligible shantytown renovation projects. Encourage qualified areas to give discount loans to shantytown renovation projects.

(3) Encourage private capital to participate. All localities should pay close attention to the introduction of preferential policies for shantytown renovation, encourage and guide private capital to participate in shantytown renovation through direct investment, indirect investment and entrusted agent construction, and attract powerful and reputable real estate development enterprises and social forces to participate. The Provincial Department of Housing and Urban-Rural Development should guide all localities to actively recommend shantytown renovation projects and honest and trustworthy real estate development enterprises to financial institutions such as the China Development Bank, and strive for the support of financial institutions.

(4) Actively issue various bonds. Guide qualified local government financing platform companies and enterprises that implement shantytown renovation projects to issue various types of bonds to be used exclusively for shantytown renovation projects. For the issuance of corporate bonds for shantytown renovation, priority should be given to the examination and approval procedures to improve the efficiency of examination and approval.

(5) State-owned industrial and mining enterprises increase capital investment. State-owned industrial and mining enterprises should actively participate in the transformation of their state-owned industrial and mining shanty towns, increase investment in transformation funds, and support the solution of some transformation funds. State-owned industrial and mining enterprises participate in the transformation of state-owned industrial and mining shanty towns organized by local governments, and the expenses that meet the prescribed conditions are allowed to be deducted before enterprise income tax. State-owned industrial and mining enterprises involved in the transformation of shanty towns should actively raise funds for the transformation, and shanty town residents should reasonably bear part of the funds for the construction of resettlement houses.

Verb (abbreviation of verb) implements preferential policies.

(1) Ensure that the land supply is in place. Housing land for shantytown renovation and resettlement should be included in the annual land supply plan of all localities, giving priority to it. The shantytown renovation project, which has been included in the affordable housing project, involves the demolition and construction land index, and should be planned separately, and should be guaranteed according to the ability, not occupying the local land index. On the premise of conforming to the local urban and rural planning and the overall land use planning, the construction standards, preferential policies, supply targets and property rights relations can be implemented with the approval of the municipal government at or above the prefecture level. For shanty towns that are scattered and difficult to transform, they can be integrated nearby and incorporated into other shantytown renovation projects to coordinate the construction. Where the land in shanty towns is transferred by means of bidding, auction or listing for transformation, the number of sets of resettlement houses, the building area and the construction standards shall be clearly stipulated in the contract for transferring the right to use state-owned construction land. Shantytown renovation projects that acquire land through transfer shall be managed in accordance with the provisions of "two lines of revenue and expenditure", and all of them shall be used for the construction of infrastructure and supporting facilities for shantytown renovation. For the land that has been included in the transformation of shanty towns, all localities and relevant departments should intensify law enforcement inspection to ensure the integrity of land supply.

(two) the implementation of tax relief policy. For shantytown renovation projects, administrative fees and government funds such as supporting fees for urban infrastructure will be exempted. Business tax, property tax, urban land use tax, land value-added tax, stamp duty and deed tax involved in shantytown renovation shall be reduced or exempted in accordance with relevant state regulations. Support shantytown renovation projects to build affordable housing and public rental housing (including low-rent housing), and enjoy corresponding preferential policies according to the proportion of construction. Personal compensation for demolition and re-purchase of resettlement houses due to demolition can enjoy personal income tax and deed tax relief according to relevant regulations. Enterprises can enjoy the pre-tax deduction policy of enterprise income tax for shantytown renovation expenses. The municipal public facilities such as cable TV, water supply, power supply, gas supply, drainage, communication, optical fiber, roads, etc. in the shantytown renovation and resettlement community are funded by the local government or relevant units, and the operating expenses such as network access and pipe network capacity expansion are levied at a low limit of half.

(3) Improve the resettlement compensation policy. The transformation of shanty towns adopts the combination of physical resettlement and monetary compensation, and the residents of shanty towns choose voluntarily. Among them, the implementation of physical resettlement, resettlement housing should give priority to the construction and resettlement of shantytown residents; Resettlement houses should be built locally and nearby, and areas with convenient transportation and perfect infrastructure should be selected for off-site construction. Where monetary compensation is implemented, the amount of compensation shall be determined according to the location, use and construction area of the house to be expropriated, and with reference to the assessed price of the real estate market. If the expropriated person chooses monetary compensation, he may be rewarded appropriately. Housing resettlement in state-owned industrial and mining shanty towns can refer to the pilot policy of shantytown renovation in Yuanquren Mine, Shaoguan City to handle relevant property certificates; Resettlement houses in other shanty towns shall handle property right certificates in accordance with relevant regulations. City and county (city, district) governments at all levels shall, in accordance with the relevant provisions of the state and province, formulate specific resettlement compensation measures and property rights management measures in light of the actual situation in the region. The Provincial State-owned Assets Supervision and Administration Commission and the Department of Housing and Urban-Rural Development should guide all localities to prepare specific plans for the transformation and resettlement of state-owned industrial and mining shanty towns, so as to achieve basic consistency and comprehensive balance in the province.

Sixth, improve the level of planning and construction.

(1) Strengthen overall planning and improve supporting facilities. The Provincial Department of Housing and Urban-Rural Development should strengthen the work docking with local and provincial SASAC, the Department of Finance, the Department of Land and Resources and other departments, comprehensively find out the basic information of various shanty towns, and establish an accurate and informative information database that is interoperable between provinces and cities. All localities should take shantytown renovation planning as an important part of the preparation of the overall urban planning and recent construction planning, and incorporate the renovation planning of state-owned industrial and mining shanty towns submitted by relevant enterprises in the region into the overall planning of local affordable housing projects, and make overall plans to promote construction. In order to optimize the planning and design level of new resettlement houses, shantytown renovation projects can appropriately increase the floor area ratio. It is necessary to closely combine the construction of the new district, the "three old" transformation and urban renewal, fully consider the needs of residents in employment, medical treatment, enrollment, pension and travel, and carry out shantytown transformation and resettlement housing construction in areas with convenient transportation and complete facilities as far as possible. Newly-built resettlement communities should plan to reserve public service houses, and simultaneously do a good job in supporting the construction of municipal infrastructure, commerce and comprehensive service facilities, and can only be delivered after passing the inspection according to regulations.

(two) improve the efficiency of examination and approval, strengthen quality supervision. All localities and relevant departments should follow the principle of convenience and efficiency, provide a green channel for project approval, implement parallel approval, simplify approval procedures and shorten the time limit for approval. Strictly implement the statutory construction procedures and technical standards, strengthen construction management, implement the responsibilities of all parties, and actively implement the lifelong responsibility system for unit leaders and project leaders to ensure the quality and safety of the project. The requirements for residential quality, building energy saving and use function should be clearly defined in the construction contract. After the completion of the project, it can be delivered only after it has passed the acceptance according to the regulations.

(3) Implement green standards to promote low-carbon development. Conscientiously implement the national and provincial green building action plan. Municipal governments at or above the local level should pay close attention to the investigation of shanty towns in the region, incorporate the provincial-level state-owned industrial and mining shanty towns in the region into the scope of transformation, organize the preparation of the shantytown transformation plan and the 20 14-20 17 annual work plan as required, clarify the shantytown transformation tasks by year and classification, decompose them into counties (cities, districts) and implement them into specific projects and construction plots. Relevant provincial state-owned industrial and mining enterprises should take the initiative to strengthen the docking with local governments and timely submit relevant information on the transformation of their state-owned industrial and mining shanty towns. The shantytown renovation plan listed at the local level should be reported to the Provincial Department of Housing and Urban-Rural Development for the record before the end of February.

(two) clear job responsibilities. The governments of cities and counties (cities, districts) at all levels are responsible for the transformation of shanty towns, and the main responsible comrades are the first responsible persons, taking overall responsibility for the transformation of shanty towns in the local area (including provincial state-owned industrial and mining shanty towns). All localities should scientifically compile the shantytown renovation plan, annual plan and resettlement compensation plan in their own areas and earnestly organize their implementation, so as to effectively achieve "seven in place" in terms of planning, funds, land supply, policies, supervision, distribution and compensation. The Provincial Department of Housing and Urban-Rural Development undertakes the daily work of the joint meeting of the provincial affordable housing project, urges and guides all localities to prepare shantytown renovation plans, annual plans and resettlement compensation plans as soon as possible, guides all localities to organize the implementation of shantytown renovation, and strengthens supervision and inspection of project construction progress and project quality. The provincial development and reform commission is responsible for the comprehensive coordination of shantytown renovation and actively strives for central subsidy funds. Provincial State-owned Assets Supervision and Administration Commission (SASAC) is responsible for taking the lead in formulating a special work plan for the transformation of provincial state-owned industrial and mining shanty towns, urging and guiding relevant provincial state-owned industrial and mining enterprises to strengthen their work docking with local governments, and coordinating and promoting the transformation of provincial state-owned industrial and mining shanty towns. Provincial Overseas Chinese Affairs Office is responsible for coordinating and guiding the renovation of dangerous houses in overseas Chinese farms. The provincial audit office is responsible for the whole process tracking audit and annual audit of shantytown renovation projects. Other relevant departments should do a good job in shantytown renovation according to the division of responsibilities.

(3) Strengthen supervision and inspection. All localities and relevant departments should strengthen the supervision, inspection and audit supervision of shantytown renovation projects, fully implement various tasks and policies and measures, and prohibit relevant units from building welfare housing through shantytown renovation policies. Provincial Housing and Urban-Rural Development Department, Supervision Department and other relevant departments should establish and improve the supervision and supervision system, and regularly supervise and inspect the transformation of shanty towns around the country.
