Legal analysis: the road traffic accident rescue fund does not need the victim to pay back the money. Relief fund is a new system stipulated in Article 17 of Road Traffic Safety Law. This system is a supplement to the compulsory liability insurance for motor vehicle traffic accidents (hereinafter referred to as "compulsory insurance"). The purpose is to ensure that victims can get timely assistance or appropriate compensation through the rescue fund when they can't get compensation according to the compulsory insurance system and the infringer.

The establishment of this system is an important measure to implement Scientific Outlook on Development. It adheres to the people-oriented principle in system design, fully embodies the care and help of the state and society for citizens' safety and health, and is a new social security system, which has very important practical and far-reaching historical significance for resolving social contradictions and promoting the construction of a harmonious society.

Article 17 The State implements a compulsory motor vehicle third-party liability insurance system and establishes a social assistance fund for road traffic accidents. Specific measures shall be formulated by the State Council.

Article 18 Non-motor vehicles that should be registered according to law can only drive on the road after being registered by the traffic administrative department of the public security organ.

The types of non-motor vehicles that should be registered according to law shall be stipulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government according to local actual conditions.

The size, mass, brakes, bells and night reflective devices of non-motor vehicles shall meet the technical standards for safety of non-motor vehicles.
