The people's governments of cities and counties (cities, districts) with districts shall, according to the needs of local economic and social development and market price regulation, arrange a certain proportion of financial budget funds as price adjustment funds every year.
The price adjustment fund of the autonomous region is raised by extracting a certain proportion from the policy premium formed in the price reform of resource products implemented by the state and the autonomous region. The specific raising standards and raising methods shall be formulated by the competent price department of the autonomous region in conjunction with the financial department of the autonomous region and submitted to the people's government of the autonomous region for approval before implementation.
Without the approval of the people's government of the autonomous region, no price adjustment fund may be raised from the society. Article 6 The price adjustment fund of the autonomous region shall be raised by the competent price department of the autonomous region, or it may be entrusted to the competent price department of a city or county (city, district) with districts or related enterprises to raise it on its behalf. Seventh to raise the price adjustment fund from the society, it should use the financial bills printed by the financial department and turn them over to the autonomous region for unified financial management. Eighth price adjustment fund payment obligor shall pay the price adjustment fund in full and on time. If major economic losses are caused by major natural disasters or major public emergencies, they may apply to the competent price department of the autonomous region for reduction, exemption or deferment of the price adjustment fund. Article 9 To apply for reduction, exemption or deferment of the price adjustment fund, the obligor of the price adjustment fund shall submit the following materials:
(1) Application for reduction, exemption or deferment of payment;
(2) Relevant financial statements;
(3) A copy of the applicant's legal person registration certificate or business license.
The application for reduction, exemption or holdover shall include the name and reasons of the applicant, as well as the amount of application for reduction, exemption or holdover and the starting and ending time. Article 10 The competent price department of the autonomous region shall, within 20 working days from the date of receiving the application for reduction, exemption or deferment of the price adjustment fund, put forward the audit opinions, and report them to the people's government of the autonomous region for approval after being audited by the financial department of the autonomous region. If it is not approved, it shall inform the applicant in writing and explain the reasons.
If it is agreed to defer payment, the time limit for deferring payment shall be specified; After the extension expires, the payer shall pay the price adjustment fund in full and on schedule. Chapter III Use Article 11 Scope of use of price adjustment funds:
(1) Subsidies given to producers and operators to stabilize the abnormal fluctuations in the prices of important commodities closely related to production and life;
(two) to give price subsidies to low-income groups whose basic life is closely related to the production and life, or the price of important commodities is greatly increased by the government;
(three) in the event of a major epidemic, major natural disasters, major public emergencies or other force majeure leading to abnormal price fluctuations, to give temporary subsidies to the producers and operators of important commodities closely related to production and life;
(four) the construction of cheap shops and cheap farmers' markets;
(five) the construction or repurchase, renovation and transformation of government-led and state-controlled farmers' markets;
(6) Policy price insurance items for basic vegetable varieties;
(seven) agricultural and sideline products production, cold chain construction;
(eight) the price adjustment fund to raise fees;
(nine) other projects determined by the people's Government of the autonomous region. Article 12 The competent price department shall, according to the actual needs of price fluctuation and price control, work out a plan for the use of the price adjustment fund in conjunction with the financial department, and report it to the people's government at the same level for approval before implementation.
The use plan of the price adjustment fund shall include the purpose, reason, amount to be used and specific operation methods.
City and county (city, district) price adjustment fund use plan shall be reported to the competent price department of the autonomous region for the record. Thirteenth applications for the use of price adjustment funds shall be submitted to the local county (city, district) price departments. If the price adjustment fund of a municipal district is co-ordinated by a city divided into districts, it may directly apply to the competent price department of the city divided into districts.
To apply for the use of the price adjustment fund, the following materials shall be submitted truthfully:
(1) Application for use;
(2) A copy of the applicant's legal person registration certificate, business license or other relevant certificates;
(3) Specific use plan.
The application for use shall include the applicant's name, reason for use, amount and payment method.
