Legal analysis: It is illegal for a company not to pay housing provident fund.

If a unit fails to register for housing provident fund deposits or fails to complete the procedures for setting up housing provident fund accounts for its employees, the housing provident fund management center shall order it to be completed within a time limit; if it fails to do so within the time limit, a fine of not less than RMB 10,000 but not more than RMB 50,000 shall be imposed.

Legal basis: Article 37 of the "Housing Provident Fund Management Regulations" violates the provisions of these Regulations and fails to register the payment and deposit of housing provident funds or fails to complete the procedures for establishing housing provident fund accounts for the employees of the unit, the Housing Provident Fund Management Center shall order it to be completed within a time limit.

; If the application is not handled within the time limit, a fine of not less than RMB 10,000 but not more than RMB 50,000 will be imposed.

Article 38 If an unit violates the provisions of these Regulations and fails to pay the housing provident fund overdue or underpays the housing provident fund, the housing provident fund management center shall order it to pay the deposit within a time limit; if the unit still fails to pay the deposit within the time limit, it may apply to the People's Court for compulsory enforcement.
