1. After an industrial accident, the industrial injury insurance fund and the employer shall pay compensation respectively according to different situations;
2. Expenses paid by the industrial injury insurance fund, such as medical expenses, are generally paid by the employer in advance and then reimbursed, and do not need to be paid to the employee himself; If the work-related injury level reaches 10 or above after the labor ability appraisal, the one-time disability subsidy will be paid by the work-related injury insurance fund, which can be paid to the company account about one month after the work-related injury appraisal is completed and the application for the work-related injury insurance fund is filed. As for when the company will transfer to the account of employees with work-related injuries, it depends on the efficiency of the employer;
Part of the expenses paid by the employer are paid monthly, such as wages during paid shutdown. If the work-related injury level reaches 10 or above after the labor ability appraisal, the employer shall also pay a one-time employment subsidy for the disabled, which shall be paid after the employees with work-related injuries leave their jobs.
The reimbursement conditions for work-related injury expenses are as follows:
1, the injured personnel must be all fixed subsidy units of the provincial finance and enjoy the national civil service Medicaid treatment;
2. Must hold a work-related injury certificate or a certificate issued by the provincial department;
3, must be a one-time medical expenses or medical expenses related to work-related injuries;
4, medical records, prescriptions, discharge summary, cost details and other related information is complete.
Legal basis: Article 14 of the Regulations on Industrial Injury Insurance.
Workers in any of the following circumstances shall be recognized as work-related injuries:
(1) Being injured by an accident during working hours and in the workplace;
(two) before and after working hours, in the workplace, engaged in preparatory or finishing work related to the work and was injured by an accident;
(three) during working hours and workplaces, due to the performance of duties by violence and other accidental injuries;
(4) Suffering from occupational diseases;
(five) during the business trip, injured or missing due to work reasons;
(six) on the way to work, I was injured by a traffic accident or an urban rail transit, passenger ferry or train accident for which I was not primarily responsible;
(seven) other circumstances that should be recognized as work-related injuries as stipulated by laws and administrative regulations.
