The development, reform, supervision and auditing departments of the people's governments at or above the county level shall do a good job in the management of price adjustment funds within their respective functions and duties. Chapter II Raising Article 7 The price adjustment fund may be raised in the following ways:
(1) financial allocation. The people's governments at or above the county level shall arrange price adjustment funds in the annual budget;
(2) social support. People's governments at or above the county level may raise price adjustment funds from resource-based and monopolistic industrial enterprises and related production and business units within their respective administrative areas. Article 8 Provincial price adjustment funds shall be raised from the following items:
(1) Electricity sold by Shandong Power Grid (excluding electricity for agricultural production and residents' life);
(2) Wholesale of refined oil and natural gas;
(3) Crude oil and natural gas mined in this province;
(4) Advance payment, deposit, deposit, etc. that cannot be refunded by communication and other industries. Consumer's;
(five) the goods and services approved by the competent price department of the provincial people's government to adopt special price policies;
(six) other projects approved by the provincial people's government.
The raising standards and payment obligors of the items listed in the preceding paragraph shall be determined by the provincial people's government and announced to the public. Ninth districts of the city and county (city, district) people's government price adjustment fund raising methods, projects, standards and payment obligations, formulated by the local people's government and announced to the public.
The people's governments at lower levels shall obtain the consent of the competent price departments of the people's governments at higher levels when raising price adjustment funds for the goods and services priced by the competent price departments of the people's governments at higher levels. Tenth people's governments at or above the county level shall, according to the needs of local economic and social development and market price regulation, gradually increase the proportion of financial funds in the price adjustment fund, and timely adjust the raising items, standards and payment obligations. Eleventh price adjustment funds raised by the competent price departments of the people's governments at or above the county level; According to the needs of the work, the competent price department may entrust other relevant departments and units to raise funds. Financing expenses shall be arranged by the financial department at the same level through budget.
The competent price department shall timely submit the financing information to the finance department at the same level. Twelfth to raise the price adjustment fund shall not have the following acts:
(a) in addition to the price of goods or services, increase the price;
(two) adopt different standards for the same goods and services;
(3) Repeated raising for the same payer. Thirteenth price adjustment fund payment obligor shall pay the price adjustment fund in full and on time.
The payer shall declare the payable amount to the competent price department in accordance with the regulations, and truthfully submit relevant materials. Failing to declare or submit relevant materials within the time limit, the competent price department may verify the amount payable according to the relevant financial information. Article 14 Under any of the following circumstances, the payer of the price adjustment fund may apply for reducing, exempting or postponing the payment of the price adjustment fund:
(a) due to major epidemics, public emergencies caused significant economic losses;
(2) Causing heavy economic losses due to natural disasters or other force majeure;
(3) Other circumstances stipulated by the people's government at or above the county level. Fifteenth to apply for reduction, exemption or deferment of the price adjustment fund, an application shall be submitted to the competent price department of the people's government at or above the county level, and the following materials shall be submitted truthfully:
(1) Application for reduction, exemption or deferment of payment;
(2) A copy of the applicant's legal person registration certificate or business license;
(3) Financial and accounting statements and relevant production and operation data and other materials.
The application for reduction, exemption or deferment shall include the name of the applicant, the reasons for applying for reduction, exemption or deferment, the amount and the starting and ending time. Article 16 The competent price department of the people's government at or above the county level shall, within 20 working days from the date of receiving the application for reduction, exemption or deferment of the price adjustment fund, put forward the examination opinions, and report them to the people's government at the corresponding level for examination and approval after being approved by the financial department. If approval is granted, the specific amount and time limit of reduction, exemption or deferment shall be specified; If it is not approved, it shall explain the reasons in writing and inform the applicant.
Without approval, the price adjustment fund shall not be reduced, exempted or deferred.
