Chapter I General Provisions Article 1 In order to strengthen the management of social assistance funds for road traffic accidents and provide timely assistance to victims of road traffic accidents according to law, these measures are formulated in accordance with the Law of the People's Republic of China on Road Traffic Safety, the Trial Measures for the Management of Social Assistance Funds for Road Traffic Accidents (Decree No.56 of the Ministry of Finance) and other laws, regulations and provisions. Article 2 These Measures shall apply to the establishment, collection, use, supervision and management of social assistance funds for road traffic accidents within the administrative area of this Municipality.

The term "rescue fund" as mentioned in these Measures refers to the social special fund raised according to law to advance the funeral expenses of the victims in motor vehicle road traffic accidents and part or all of the rescue expenses. Article 3 The principle of unified policy, graded raising, territorial management and division of responsibilities shall be applied to relief funds. Article 4 The municipal and county (city) people's governments shall set up relief funds, and Haishu, Yinzhou and Jiangbei districts shall be included in the municipal relief funds.

The municipal relief fund is used for personal injury relief and rescue expenses in motor vehicle road traffic accidents in Haishu, Yinzhou and Jiangbei districts.

County (city) level relief funds are used for personal injury relief and rescue expenses in motor vehicle road traffic accidents within their respective administrative areas. Article 5 The municipal, district and county (city) shall set up a leading group for the management of relief funds, which is composed of departments of finance, insurance supervision, public security, health, agriculture (agricultural machinery) and auditing, and shall be responsible for coordinating and studying the operation of relief funds, and examining and approving important matters and related matters submitted by the competent departments of relief funds.

The relief fund management leading group has an office, which is located in the finance department at the same level. Article 6 The financial department is the competent department of the relief fund, and shall study and formulate relevant policies of the local relief fund together with relevant departments, and supervise and inspect the collection, use and management of the relief fund at the same level.

Ningbo Insurance Regulatory Bureau is responsible for supervising insurance companies to pay relief funds to the relief fund management institutions at the municipal, district and county (city) levels on time and in full.

The traffic administrative department of the public security organ is responsible for notifying the relief fund management institution to advance the rescue expenses of the victims of road traffic accidents, guiding and supervising the daily operation of the relief fund management institution, and assisting the relief fund management institution to recover from the persons responsible for road traffic accidents.

The competent department of agricultural machinery is responsible for assisting the relief fund management institution to recover from the person responsible for the traffic accident of agricultural machinery.

The competent department of health is responsible for supervising medical institutions to timely rescue victims in road traffic accidents according to the Guidelines for Clinical Diagnosis and Treatment of Injured Persons in Road Traffic Accidents, and apply for a rescue fund to advance the rescue expenses. Article 7 A city or county (city) shall set up a relief fund management institution with legal personality to perform the duties of relief fund management.

The relief fund management institution is located in the traffic management department of the public security organ at the same level. Chapter II Raising of Relief Funds Article 8 The sources of relief funds include:

(a) according to a certain proportion of motor vehicle traffic accident liability compulsory insurance (hereinafter referred to as compulsory insurance);

(2) Subsidies given by local finance according to the amount of value-added tax paid by insurance companies for compulsory insurance;

(three) fines for motor vehicle owners and managers who fail to apply for compulsory insurance according to regulations;

(four) the fruits of the relief fund;

(five) the funds recovered from the person responsible for the motor vehicle road accident according to law;

(six) the net income of the public bidding for the special number plate number of small passenger cars;

(seven) special funds arranged by the local financial budget;

(8) Social donations;

(9) Other funds. Article 9 Before March 15 of each year, the Municipal Finance Bureau and Ningbo Insurance Regulatory Bureau shall, according to the income and expenditure of the relief fund in the previous year of this Municipality and the principle of balance of income and expenditure, determine the specific extraction ratio of this Municipality in that year within the scope of the proportion of the relief fund extracted from the premium income of compulsory insurance in that year announced by the Ministry of Finance and the China Insurance Regulatory Commission. Article 10 A municipal insurance institution handling compulsory insurance business shall separately withdraw funds from the compulsory insurance premium income of municipal insurance institutions and their branches according to the withdrawal ratio determined by the Municipal Finance Bureau and Ningbo Insurance Regulatory Bureau, and transfer them to the special account of municipal rescue fund by bank transfer within 10 working days after the end of each quarter, and provide detailed information on the withdrawal of municipal, county (city) and district rescue funds. After receiving the above funds, the municipal relief fund management institution shall timely and fully allocate them to the county (city) level relief fund accounts. Article 11 When an insurance company engages in compulsory insurance business, it shall separately report the premium income and the value-added tax payable to the tax authorities.

The tax department of the county (city) shall, within 5 working days after the end of each quarter, provide the local financial department with the information on the insurance company's payment of value-added tax on compulsory insurance this quarter. The financial department of the county (city) shall, according to the current budget and the amount of value-added tax paid by the insurance company this quarter, transfer the subsidy funds to the special account of the rescue fund at the corresponding level within 10 working days after the end of each quarter.

The district tax department shall provide the Municipal Finance Bureau with the information about the insurance company's payment of value-added tax for compulsory insurance this quarter within 5 working days after the end of each quarter. According to the current year's budget and the value-added tax paid by insurance companies this quarter, the Municipal Finance Bureau will handle budget additions and transfer payments within 10 working days after the end of each quarter. The Municipal Finance Bureau shall, within 5 working days, allocate the funds belonging to the municipal relief fund to the special account of the municipal relief fund; After receiving the transfer payment funds, the district finance should dial into the special account of the rescue fund at the corresponding level within 5 working days.
