Chapter I General Provisions Article 1 In order to continuously optimize the business environment, safeguard the legitimate rights and interests of market participants, stimulate market vitality and promote high-quality development, these Regulations are formulated in accordance with the State Council's Regulations on Optimizing the Business Environment and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the work of optimizing the business environment within the administrative area of this province. Article 3 Optimize the business environment, adhere to the principles of marketization, rule of law and internationalization, take the needs of market participants as the guide, take the profound transformation of government functions as the core, innovate the system and mechanism, strengthen coordination, improve the protection of the rule of law, benchmark the international and domestic advanced levels, and create a stable, fair, transparent and predictable good environment for all kinds of market participants to invest and start businesses. Article 4 People's governments at all levels shall strengthen the organization and leadership over the work of optimizing the business environment, establish and improve a comprehensive coordination mechanism, promote and supervise the implementation of the work of optimizing the business environment as a whole, coordinate and solve major problems in the work, and incorporate the work of optimizing the business environment into the annual target responsibility assessment.

The competent department of development and reform of the provincial people's government and the competent department of optimizing the business environment determined by the municipal and county people's governments are responsible for the guidance, organization, coordination and supervision of optimizing the business environment within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall do a good job in optimizing the business environment in accordance with the division of responsibilities. Article 5 The competent department of development and reform of the provincial people's government shall carry out evaluation according to the requirements of the national and provincial business environment evaluation system. Municipalities (states), counties (cities, districts, administrative committees) and departments should timely adjust and improve policies and measures to optimize the business environment according to the results of the business environment assessment.

The competent department of development and reform of the provincial people's government shall establish a business environment monitoring mechanism, build a unified business environment monitoring platform in the province, dynamically monitor various data indicators, and track the implementation of various business environment reform measures. Article 6 All regions and departments are encouraged and supported to actively explore original and differentiated specific measures to optimize the business environment within the framework of the rule of law, and to replicate and promote effective reform measures inside and outside the province.

Encourage and support economic development zones, industrial parks and other parks to play a leading and exemplary role in optimizing the business environment, and try out various reform measures conducive to optimizing the business environment.

There are mistakes or deviations in the exploration, but they do not violate the mandatory provisions of laws and regulations, conform to the reform direction set by the state and the province, are diligent and conscientious, and do not seek personal gain, and can be exempted or mitigated. Article 7 People's governments at all levels, relevant departments and news media shall publicize the measures and effects of optimizing the business environment, guide the whole society to participate in and support the construction of the business environment, and create a good public opinion atmosphere for optimizing the business environment. Chapter II Market Environment Article 8 People's governments at all levels and relevant departments shall strictly implement the national unified negative list system for market access, and shall not separately formulate negative lists of market access nature. In areas other than the negative list of market access, all kinds of market entities can enter equally according to law.

Areas outside the negative list of national foreign investment access shall be managed in accordance with the principle of consistency between domestic and foreign investment. Article 9 All kinds of market entities shall equally apply the national and provincial policies to support development according to law, and equally enjoy the right to use various production factors and public service resources such as capital, technology, human resources, land use rights and other natural resources. Tenth people's governments at all levels and relevant departments can attract social investment through cooperative development, cooperative management, cooperative construction, formation of consortia, equity investment, creditor's rights investment, and revitalizing existing assets.

Encourage and support all kinds of market players to participate in accelerating the construction of a world-class salt lake industrial base, build a national clean energy industry highland, an international eco-tourism destination, and an export destination of green organic agricultural and livestock products, build a green and low-carbon circular development economic system, and build a modern economic system that reflects the characteristics of this province. Eleventh relevant departments of the people's governments at or above the county level shall, in accordance with the relevant provisions of the state, simplify the procedures that enterprises need to go through from applying for establishment to having general operating conditions, and implement online feedback on the whole process of starting enterprises and handling matters. The processing time for enterprise establishment registration, seal engraving and initial invoice application shall not exceed 3 working days. Twelfth administrative fees, government funds, business service fees and enterprise-related deposits established according to law shall be managed by the list, dynamically adjusted and published regularly. Contents outside the directory list shall not be executed.

The charging unit shall publicize the charging basis and standard in the charging place and the portal website of the unit. Thirteenth people's governments at or above the county level shall establish and improve the mechanism of industrial integration and docking, and publish policies such as industry and financing, as well as information such as project investment and investment attraction.

Encourage and support financial institutions to establish specialized financial credit classification, mass marketing, standardized loan review and differentiated authorization mechanisms for private enterprises and small and medium-sized enterprises, and promote the use of intellectual property rights, equity, accounts receivable, orders, insurance policies and other means for secured financing.

Encourage financial institutions to provide unsecured, unsecured and preferential interest rate financing services to small and medium-sized enterprises with good credit, so as to reduce financing costs. Financial institutions shall not set unreasonable conditions in financing services, and shall not set discriminatory requirements for private enterprises and small and medium-sized enterprises.

Encourage and support all kinds of qualified market entities to expand the scale of direct financing by issuing stocks, bonds and other financing instruments according to law.
