The sources of special funds for cultivated land development include:
(1) Special funds for cultivated land development;
(two) 80% of the basic farmland development fund;
(3) Land idle fee;
(four) other land income used for cultivated land development according to regulations. Article 3 Special funds for cultivated land development shall be managed according to extra-budgetary funds, stored in special accounts, earmarked for special purposes, with two lines of revenue and expenditure. Accordingly, the establishment of "special funds for cultivated land development", "basic farmland development fund", "land idle fees" and "other income" and other subjects, by the land management department to prepare a plan for the use of funds, arrangements for the use, and reported to the finance department at the same level for review and disbursement. No unit or individual may occupy or misappropriate.
The special funds for cultivated land development collected by the land management department should use the bills uniformly printed by the provincial finance department. Article 4 The scope of use of special funds for cultivated land development includes:
(a) support units or individuals to develop cultivated land and expand the area of cultivated land;
(two) the construction of basic facilities necessary for the continuous reclamation of new cultivated land;
(three) the preparation of cultivated land development plan and annual plan, the protection and management of basic farmland;
(4) The matching funds for farmland development of agricultural comprehensive development projects are mainly used for large and medium-sized coastal reclamation projects to expand the area of cultivated land. Article 5 Units and individuals that use cultivated land for non-agricultural construction shall, in addition to complying with the provisions of Article 7 of the Measures for the Administration of Cultivated Land Development in Fujian Province, pay the special funds for cultivated land development in one lump sum according to the following criteria:
(a) paddy field 45000 yuan per hectare;
(2) Dry land is 30,000 yuan per hectare. Sixth special funds for cultivated land development by the city and county (District) land management department levy. Units and individuals that have approved the use of cultivated land for non-agricultural construction shall pay special funds for cultivated land development to designated banks within the prescribed time limit on the basis of the amount of payment approved by the land management department of the city or county (district) and the notice of payment issued. If the special fund for cultivated land development has not been paid, the land management department shall not go through the formalities for land use, and governments at all levels shall not approve land use. Seventh special funds for cultivated land development, the implementation of provincial, prefectural (city) and county (city, district) land management departments are divided into three levels. The county (city, district) land management department shall turn over 15% of the special funds for cultivated land development collected last month to the provincial land management department and 15% to the local (city) land management department before the 5th day of each month; Special funds for cultivated land development directly collected by prefecture-level cities should be turned over to the Provincial Bureau of Land Management 20% before the 5th of each month, which is mainly used for organizing reclamation and centralized contiguous development of cultivated land. Article 8 If it is really necessary for non-agricultural construction projects to use cultivated land in the basic farmland protection areas, in addition to paying special funds for cultivated land development, they should also pay the basic farmland development fund to the provincial land management department in accordance with the standards stipulated in the schedule of these Measures when handling the basic farmland use certificate. Article 9 80% of the basic farmland development fund collected by the provincial land management department shall be used by the land management department for cultivated land development. 20% by the agricultural sector to arrange the transformation of low-yield fields (specific use and management measures shall be formulated by the agricultural sector and the financial sector).
According to the regulations, 80% of cultivated land is divided into three levels: provincial, prefectural (city) and county (city, district) land management departments, of which 60% are at the county level and 20% are at the provincial (city) level. The land departments of prefectures (cities) and counties (cities, districts) are divided, and the basic farmland development fund collected last month will be transferred back to the corresponding prefectures (cities) and counties (cities, districts) by the Provincial Bureau of Land Management before the 5th of each month. Tenth non-agricultural construction approved the use of cultivated land, more than the statutory period of unused, by the local city and county (District) land management departments in accordance with the following provisions to land units or individuals to collect land idle fees:
(a) in violation of the "Regulations on the Protection of Basic Farmland in Fujian Province", if the land has not been used for more than one year, it will be charged at 5 yuan to 10 yuan per square meter per year.
(two) in violation of the "Measures for the Assignment and Transfer of State-owned Land Use Rights in Fujian Province", if the unused land is postponed for one year, it will be charged at 10% of the total transfer fee; If the land is not used for two years, it will be charged at 20% of the total transfer fee every year.
(three) in violation of the Interim Measures for the administration of allocated land use rights in Fujian Province, if the unused land is extended for one year, it will be charged at 5% of the demarcated land price on the date of approving the extension; If the unused land is postponed for two years, it will be charged at 10% of the land price on the date of approval of the extension every year.
(4) If the land is idle for more than half a year but less than one year in violation of the Interim Measures for the Administration of Foreign-invested Development and Management of Pieces of Land in Fujian Province, it will be collected according to 10% of the total land transfer fee; If the land is idle for more than one year but less than two years, it will be charged at 20% of the total land transfer fee.
At the same time, in violation of the above two provisions, the land idle fee shall be charged according to the provisions with the highest standard.
