Article 2 These Measures shall apply to retired officers and retired non-commissioned officers who receive monthly retirement fees for resettlement.
Article 3. Receive the resettlement retirement pension on a monthly basis, and adhere to the principles of highlighting service contributions, respecting preferential treatment, encouraging employment and entrepreneurship, and being included in social security.
Article 4 The competent department of retired military personnel in the State Council shall be responsible for coordinating the reception and resettlement of retired military personnel who receive monthly retirement benefits throughout the country. The competent department of the work of retired soldiers of the provincial people's government shall, according to the monthly resettlement plan for retired soldiers who receive retirement benefits issued by the state, conduct file review and approval of the resettlement site. The competent department of the people's government at the city or county level shall be responsible for the reception, resettlement, service management, education and training, employment and entrepreneurship support, and the approval and issuance of the retired military personnel who receive the retired gold every month within their respective administrative areas.
The Political Work Department of the Central Military Commission is responsible for coordinating the review and transfer of retired military personnel who receive monthly retirement benefits. The relevant departments of units at or above the regimental level are responsible for sorting out the files of retired soldiers who receive retirement benefits every month, identifying the service situation and approving the retirement benefits. The provincial military regions (including garrison commands and garrison commands) are responsible for transferring the retired soldiers placed by the whole army to the provinces (autonomous regions and municipalities directly under the Central Government) that receive monthly retirement benefits, and cooperate with local governments to do a good job in receiving and resettling them.
Relevant departments of the central and state organs, relevant departments of various localities and relevant units of the armed forces shall do a good job in relevant work within the scope of their respective duties.
Chapter II Resettlement Objects and Places
Article 5 Officers below senior colonel who meet one of the following conditions when retiring from service may be placed in the form of receiving a monthly retirement pension upon their own application and approval:
(a) as an officer 16 years;
(2) Having served as a non-commissioned officer or an officer for a total of 16 years;
(3) Having served for 20 years;
(4) directly selecting and recruiting officers or specially recruiting officers to join the army and retiring at the age of major or above.
Article 6 A non-commissioned officer who meets one of the following conditions when he retires shall apply by himself, and may receive a monthly retirement pension for resettlement upon examination and approval:
(a) as a sergeant 16 years;
(2) Length of service 18 years;
(3) Having been promoted (awarded) to the rank of sergeant major four or above, and having served in this rank for six years, with a cumulative service of 14 years.
Article 7 Officers and non-commissioned officers shall not receive retirement fees on a monthly basis under any of the following circumstances:
(a) at least 50 years of age and can retire;
(two) disabled by medical appraisal can retire or basically lose the ability to work;
(three) the review has not yet reached a conclusion or the probation period has not expired;
(4) Being expelled from the Party or being subjected to criminal punishment for intentional crimes;
(five) due to other reasons stipulated by laws and regulations, it is not appropriate to receive retirement fees on a monthly basis.
Article 8 Retired officers and non-commissioned officers who receive monthly retirement benefits may return to their places of origin, enlistment or domicile at the time of enlistment, or choose the place of resettlement according to the following circumstances:
(a) can be placed in the spouse before joining the army, at the time of marriage or the current residence, without a spouse, can be placed in the resident according to the conditions of the resident military spouse; You can put it in a place where either your parents or your spouse's parents have an account. If both or one of my parents is a soldier, they can be placed in the place of origin, enlistment or retirement of either parent. Officers who meet the prescribed conditions may be placed in the place where their children are registered. Children of officers and noncommissioned officers in active service who meet the requirements of spouses of soldiers stationed in the army may also be placed in children's troops. Among them, those who are placed with their spouses or spouses' parents must comply with the provisions of the army on the marriage of active servicemen.
(2) If both husband and wife are military officers, both parties or one party shall receive a monthly retirement pension for resettlement, which may be placed in either party's military station, place of origin, place of enlistment or place of residence when enlisting; One of the husband and wife is an officer, and the other is a non-commissioned officer who meets the working conditions, and receives a monthly retirement fee, pension or maintenance. If both parties or one party receives a monthly retirement fee for resettlement, they can be resettled in either party's military station, place of origin, place of enlistment or place of residence when enlisting; If both husband and wife are non-commissioned officers, both parties or one of them can take the form of receiving a monthly retirement pension for resettlement. Those who meet the conditions of accompanying the army can be placed in the military station of the party.
(3) Other circumstances stipulated by the state.
Resettlement of retired officers in megacities identified in the State Council shall comply with the relevant provisions of the state and the army on the resettlement of retired officers in megacities; Retired noncommissioned officers who have settled in a megacity determined by the State Council have been married for 2 years, which conforms to the relevant policies and regulations on settling in this megacity. Retired officers and non-commissioned officers who were students of ordinary colleges and universities when they joined the army, but did not return to school after retirement, their resettlement places are the places where their pre-school accounts are located.
Chapter III Payment and Adjustment of Retirement Fees
Article 9 Retirement benefits are divided into two stages: before and after the national statutory retirement age. Before reaching the national statutory retirement age, the retirement pension shall be paid monthly according to the regulations; After reaching the national statutory retirement age, they will enjoy basic pension, occupational annuity and other pension insurance benefits in accordance with regulations, and continue to retain a certain proportion of retirement benefits for life.
Article 10 In accordance with these Measures, the current salary of military personnel and the average salary of employed persons in urban units across the country shall be announced, and the retirement pension base shall be determined by comprehensively considering the construction of the ranks of officers and noncommissioned officers and the actual placement of retired military personnel. See attached table 1 for specific standards.
Article 11 The State establishes a pension adjustment mechanism. According to the level of economic and social development, financial situation and other factors, the retirement pension will be adjusted with reference to the adjustment range and frequency of the basic pension for retirees in enterprises, institutions and institutions.
Article 12 Retirement fees shall be determined according to the service life of officers or noncommissioned officers and a certain proportion of the calculation base of payment. The specific calculation and payment ratio shall be implemented in accordance with the following provisions:
(1) For retired officers who have served as officers for 16 years or have served as noncommissioned officers and officers for 16 years, the retirement fee shall be determined according to 60% of the calculation base; If it exceeds 16 years, the calculation and development ratio will increase by 2% for every increase of 1 year; In accordance with the provisions of Item 4 of Article 5 of these Measures, if it is less than 16 years, the calculated development ratio will be reduced by 2% for each full 1 year.
(two) retired noncommissioned officers served for 16 years, and the retirement fee shall be determined according to 50% of the calculation base; If it exceeds 16 years, the calculation and development ratio will increase by 2% for every increase of 1 year; In accordance with the provisions of the third paragraph of Article 6 of these Measures, if it is less than 16 years, it will be reduced by 2% for each full 1 year.
Article 13 For retired officers and noncommissioned officers who have won military honors and served in hard and remote areas and special posts for a long time, a certain proportion of retirement pension will be added according to the plan and payment base, and the specific proportion will be implemented in accordance with the following provisions:
(a) during the period of service, those who won class III, class II and class I were increased by 2%, 4% and 8% respectively; Those who have won Class IV, Class III, Class II and Class I will be awarded 2%, 4%, 8% and 12% respectively. Won the medal, honorary title, the proportion of increase15%; Those who have won second-class merit and obtained approval and first-class merit will be given a higher pension ratio according to the standards of second-class merit and first-class merit. Those who have won honorary commendation for meritorious service for many times may have a cumulative proportion, and the cumulative proportion shall not exceed15%; The cumulative issuance ratio of meritorious service and honor at this level shall not exceed that of the previous level; If the same enterprise has won more than two meritorious service honors, the proportion of additional issuance is high.
(2) The length of service in more than three types of hard and remote areas in Xizang Autonomous Region 10 years, accounting for an increase of 5% in the total development; If it exceeds 10 year, the annual expense ratio will increase by 2%, 1 .5%, 1.2%, 0.8% and 0.5% respectively in Xizang Autonomous Region and the six, five, four and three types of hard and remote areas. According to the relevant standards of five, four and three kinds of hard and remote areas, we will increase the services of special islands, first-class islands and second-class islands. In the same area, in line with the conditions of hard and remote areas and islands, the implementation.
The proportion of additional retirement benefits for service in the above areas can be accumulated, and the accumulated proportion shall not exceed 15% except for resettlement in the above areas.
(3) Those who have served in flight, naval vessels or nuclear-related posts for 10 years will be increased by 5%. Retired officers who have served as chief officers of divisions, brigades, regiments and battalions of combat troops for a total of three years will receive an additional 2%.
Fourteenth in accordance with the provisions of Article 12 and Article 13 of these measures, the proportion of retirement fee shall not exceed 100%.
Article 15 Retired soldiers who receive monthly retirement benefits have served in Xizang Autonomous Region and the hard and remote areas above Grade III for 10 years, settled in the above-mentioned areas, paid basic old-age insurance premiums according to regulations, and given regional subsidies before reaching the statutory retirement age of the country. See Schedule 2 for specific standards. The regional subsidy standards are adjusted with the national subsidy standards in hard and remote areas, and the subsidy standards in Xizang Autonomous Region are adjusted accordingly according to the six types of subsidy standards in hard and remote areas.
Before reaching the national legal retirement age, if I have no actual working and living conditions in the above-mentioned areas for more than 12 months, or if my household registration moves out of the above-mentioned areas, I will stop paying regional subsidies from next month.
Sixteenth retired soldiers who receive monthly retirement benefits, when they reach the statutory retirement age of the country, will retain a certain proportion of retirement benefits (including subsidies for hard and remote areas) from the next month and pay them for life according to regulations. Among them, the retention ratio of officers and non-commissioned officers 16 years is 20%, the retention ratio increases 1% every 1 year, and decreases 1% every1year, and the retention ratio does not exceed 25%. For those who have worked in areas above 3500m above sea level and have been placed in such areas, the retention ratio will increase by 1% for every year they have worked in such areas, with a maximum of 10%.
Retained retirement pension shall be adjusted in accordance with the provisions of Article 11 of these Measures.
Article 17 When determining the proportion of retirement fee and relevant treatment, the service years of officers and noncommissioned officers, service years in hard and remote areas, service years of special posts, etc. Less than 65,438+02 months shall be converted on a monthly basis. The starting and ending time of the fixed number of years is determined according to the employment order.
The service time of officers and non-commissioned officers in these Measures (including the service time in hard and remote areas and special posts) does not include the time served for criminal punishment and the time served in the army after approval for retirement.
Eighteenth retired soldiers who receive monthly retirement benefits are employed as civil servants or staff of public institutions, and the retirement benefits will be stopped from the next month, and their social insurance will be transferred in accordance with state regulations.
If a retired soldier who receives a monthly retirement pension commits a crime, his retirement pension shall be stopped, reduced or cancelled in accordance with relevant state regulations, and his social insurance benefits shall be implemented in accordance with relevant state regulations.
Chapter IV Protection of Relevant Treatment
Article 19. Retired soldiers who receive monthly retirement benefits have the right to wear standard military uniforms to participate in major celebrations according to their ranks and service contributions, be buried in military cemeteries according to conditions after their death, and enjoy other political treatment as stipulated by national laws and regulations.
Party member management of retired military personnel shall be implemented in accordance with relevant regulations.
Article 20 The basic old-age insurance and occupational annuity subsidies for retired soldiers who receive monthly retirement benefits shall be calculated according to the method for retired soldiers who are placed in enterprises. The insurance relationship and subsidy funds shall be transferred according to the relevant regulations of the state and the army. Those who are employed after retirement will continue to pay the basic old-age insurance premium in accordance with relevant state regulations, and those who are unemployed can participate in the basic old-age insurance as flexible employees. Those who meet the conditions for receiving the basic old-age insurance benefits stipulated by the state shall enjoy the old-age insurance benefits.
Twenty-first retired soldiers who receive monthly retirement benefits shall participate in the basic medical insurance in the resettlement areas in accordance with the regulations and enjoy the corresponding medical insurance benefits. When retiring, the medical insurance relationship will be transferred to the medical security agency in the resettlement place according to the regulations, and the personal account funds will be transferred to my new account during my working period according to the regulations. After retirement, due to personal physical and mental condition, family practical difficulties and other reasons, employees who participate in the basic medical insurance unit shall be paid by the competent department of retired military personnel in the resettlement place to the local medical insurance fee collection agency, and the required funds shall be solved by the people's government in the resettlement place; Individual contributions are paid by individuals in accordance with regulations. Retired officers who receive retirement benefits on a monthly basis shall enjoy corresponding treatment with reference to the Medicaid standard for civil servants on the basis of participating in the basic medical insurance for employees.
Twenty-second retired soldiers who receive monthly retirement benefits enjoy the housing treatment stipulated by the relevant provisions of the state and the army. During the service, the housing accumulation fund can be given to me at one time, or it can be transferred to the resettlement place according to my wishes when he leaves the team. Transferred to the resettlement site, you can enjoy the right to use in accordance with the provisions of the resettlement site. Eligible personnel shall be given priority under the same conditions when applying for affordable housing in the resettlement place.
Twenty-third retired soldiers who receive monthly retirement benefits enjoy the preferential policies of the state to support the employment, entrepreneurship, education and training of retired soldiers. Local people's governments at all levels provide targeted employment introduction and employment guidance services to those who are unable to find employment or have been unemployed for a certain period of time due to physical conditions, skill levels and other reasons; Those who meet the conditions of people with employment difficulties shall enjoy employment assistance policies such as social insurance subsidies and public welfare job placement in accordance with regulations.
Article 24. Spouses and children of retired officers and retired non-commissioned officers who are placed in the form of receiving monthly retirement fees meet the requirements of the army, and are transferred to schools with them in accordance with the relevant provisions on the arrangement of jobs for demobilized officers and retired non-commissioned officers.
Article 25 If a retired soldier who receives a monthly retirement pension dies, he shall be given a pension and funeral subsidy in accordance with the relevant provisions of the state, and the fund balance of his personal account for basic old-age pension and basic medical insurance and his occupational annuity account for servicemen can be inherited.
Twenty-sixth monthly retirement fees, regional subsidies, education and training, service management funds, etc. According to the division of financial affairs and expenditure responsibilities, they shall be borne by the central and local governments respectively.

Article 27 These Measures shall apply to retired police officers of the Chinese People's Armed Police Force.
The provisions on officers in these Measures shall apply to civilian cadres in the army.
Retired officers who did not participate in the grade conversion in the reform of the officer system shall be implemented with reference to these measures.
After the implementation of the new soldier system, these measures shall apply to non-commissioned officers who change their new ranks.
Article 28 These Measures shall be interpreted by the Veterans Affairs Department and the Political Work Department of the Central Military Commission.
Article 29 These Measures shall come into force as of the date of promulgation.
