Organizations confirmed and authorized by the relevant administrative departments or people's governments at or above the county level are the competent business units of relevant social organizations, and perform supervision and management duties according to law, unless otherwise stipulated by the state.
Development and reform, finance, taxation, human resources and social security, foreign affairs, auditing, public security and other relevant administrative departments are responsible for the supervision and management of social organizations within their respective functions and duties. Article 6 Social organizations shall establish an internal management system with articles of association as the core, and improve the mechanisms of democratic election, democratic decision-making, democratic management, democratic supervision, honesty, self-discipline and good faith.
The articles of association of social organizations shall comply with the provisions of laws and regulations. Article 7 A social organization shall establish an internal information disclosure mechanism, and disclose its main activities, financial status, work reports and other information to its members at least once a year.
If a social organization accepts donations and subsidies, it shall announce the information of accepting donations and subsidies to the public within 15 working days after accepting donations and subsidies, and disclose the relevant information of donations and subsidies in the annual report. Article 8 Unless otherwise provided by laws and regulations, all assets and income of social organizations shall be used for the business scope and the development of public welfare undertakings as stipulated in the articles of association.
The property disposal of social organizations shall conform to the purpose and business scope of service activities stipulated in their articles of association, and shall not be distributed among members. Article 9 Social organizations shall implement the accounting system of non-governmental non-profit organizations stipulated by the state.
Social organizations shall ensure that accounting data are legal, true, accurate and complete, and keep accounting data in accordance with relevant regulations. Article 10 Social organizations shall abide by the provisions of the Constitution and laws and shall not violate social morality.
Social organizations shall not engage in the following acts:
(a) forcing units and individuals to join or restrict their withdrawal from social organizations, except as otherwise provided by laws and regulations;
(2) imposing property or personal punishment on members of the organization;
(three) forcing units and individuals to donate or forcibly apportion;
(4) using overseas donations or subsidies to engage in activities that endanger national security and disrupt social order, and social organizations that are not religious groups use overseas donations or subsidies to engage in religious activities;
(five) to carry out appraisal, compliance and commendation activities related to enterprises outside the members of social organizations;
(6) Acts unrelated to the aims and articles of association of social organizations. Article 11 If a social organization has the following major activities, it shall submit a written report to the registration authority and relevant competent departments before the major activities 10, and submit relevant materials such as the contents, methods, scale, participants, time, place and funds of the activities:
(1) Convening a general meeting of members (members' representatives);
(2) Accepting donations or subsidies from abroad;
(3) Foreign-related and activities involving Hong Kong, Macao and Taiwan;
(four) foundations and charitable organizations to carry out fund-raising activities for the public;
(5) Other major matters. Article 12 The registration administration organ shall, jointly with relevant departments, establish the system of appointment, interview, warning and prohibition of employment of the person in charge of social organizations, and implement the audit system of appointment and departure of legal representatives. Thirteenth registration authorities shall, jointly with relevant departments, establish a supervision mechanism for social organization funds, and make a risk assessment on the operation of social organization funds. Article 14 The registration administration organ shall improve the classified evaluation system of social organizations, establish a third-party evaluation mechanism of social organizations, and take the evaluation conclusion as an important basis for the government to transfer functions to social organizations and purchase services. Fifteenth registration authorities should establish credit files of social organizations, and incorporate them into the public credit information management system, promote social organizations to establish a credit commitment system, and take credit incentive and disciplinary measures. Article 16 The registration administration organ shall establish a platform for publishing information on social organizations, and timely and accurately disclose information that should be announced and publicized according to law, such as the registration administration of social organizations. Seventeenth to encourage the public and the news media to supervise social organizations.
Units and individuals have the right to report illegal acts of social organizations. After receiving the report, the registration authority and relevant departments shall handle it according to law. If the report is verified, it will be rewarded. Eighteenth social organizations in violation of the provisions of these measures, outside the members of social organizations to carry out enterprise-related appraisal activities in recognition of standards, by the registration authority shall be given a warning, ordered to correct or stop activities, and may be ordered to replace the relevant responsible personnel; If the circumstances are serious, the registration shall be cancelled.
