In order to strengthen the management of rural medical assistance funds and ensure the rational and effective use of funds, according to the Opinions of the Ministry of Civil Affairs, the Ministry of Health and the Ministry of Finance on the Implementation of Rural Medical Assistance (Minfa [2003]158) and the relevant provisions, these Trial Measures are formulated.
Article 1 The rural medical assistance fund is a special fund for providing medical assistance to poor peasant families. The fund is raised through various channels, such as government grants and voluntary donations from all walks of life, and is managed and used in accordance with the principles of openness, fairness, impartiality, earmarking, living within our means and balancing revenue and expenditure.
Article 2 The people's government at the county level shall establish an independent rural medical assistance fund. Sources of funds include financial allocation, lottery public welfare fund, voluntary donations from all walks of life, interest income, etc.
(a) local governments at all levels should reasonably arrange rural medical assistance funds in the budget at the beginning of the year according to the actual needs and financial situation of rural medical assistance work in the region.
(two) the local civil affairs departments at all levels every year from the lottery public welfare fund reserved for the use of civil affairs departments to extract a certain proportion or a certain amount of funds for rural medical assistance.
(three) to encourage all sectors of society to donate funds for rural medical assistance.
(four) the interest income of the rural medical assistance fund.
(five) other funds that can be used for rural medical assistance according to regulations.
The financial departments at or above the county level shall give financial support to the difficult areas where the rural medical assistance system is implemented. The central government gives appropriate support to rural medical assistance in poverty-stricken areas such as the central and western regions, and the specific subsidy amount is determined by the Ministry of Finance and the Ministry of Civil Affairs according to the number of medical assistance, financial situation and work effectiveness. All the budget funds for subsidizing lower levels are transferred through the state treasury, and the transfer of extra-budgetary funds is handled in accordance with relevant regulations.
Article 3 The rural medical assistance fund shall be used for subsidizing the aid recipients to participate in the local new rural cooperative medical system, or subsidizing the medical expenses of the aid recipients suffering from major diseases, as well as the expenses of treating special infectious diseases that meet the requirements of the state. The fund must be earmarked for special purposes, and no management fees or other expenses may be drawn.
Article 4 The annual revenue and expenditure plan of rural medical assistance fund shall be implemented after being reported to the people's government at the same level for approval by the county-level civil affairs department and the financial department. The civil affairs department regularly submits the implementation of the revenue and expenditure plan to the finance department at the same level and the civil affairs department at a higher level.
Article 5 The financial department at the county level shall set up a special account for rural medical assistance fund (hereinafter referred to as "the special account for rural medical assistance fund") in the financial account of social security fund to handle the fund raising, disbursement and payment. The civil affairs department at the county level shall set up a special account for rural medical assistance funds to handle the disbursement, payment and distribution of funds.
Sixth county budget funds allocated quarterly or monthly to the finance department at the same level "rural medical assistance fund special account". The lottery public welfare fund approved for rural medical assistance should be transferred from the financial special account to the special account of rural medical assistance fund in time. The financial department at the county level shall, after receiving the subsidy funds from the higher authorities, timely and fully allocate them to the special account of rural medical assistance fund. Donations from all walks of life and other funds should be timely deposited in the special account of rural medical assistance fund of the financial department at the same level according to the principle of territorial management.
Seventh rural medical assistance to enjoy the object and the amount of assistance, by the individual to apply, the villagers' representatives meeting to discuss, the township people's government audit, the county civil affairs department according to the specific provisions of the county people's government for approval. If it is difficult for the approved relief object to participate in the payment of the local new rural cooperative medical system, it shall be funded by the rural medical assistance fund and give appropriate subsidies to the medical expenses that the seriously ill relief object cannot bear. The expenses for the treatment of special infectious diseases prescribed by the state shall be paid after approval according to relevant regulations.
Article 8 The funds for subsidizing the recipients to participate in the local new-type cooperative medical system shall be allocated to the special account of the new-type rural cooperative medical system from the "special account of rural medical assistance fund" by the county-level financial department, and the agency of the new-type rural cooperative medical system shall be notified to handle the relevant formalities. With the approval of the county-level civil affairs department, the medical assistance funds of the seriously ill relief object shall be allocated by the county-level financial department to the special account of rural medical assistance funds of the civil affairs department on time, paid by the county-level civil affairs department to the township people's government for distribution, or paid directly to the relief object by the county-level civil affairs department through banks, post offices, etc. Or other social distribution methods. Where conditions permit, centralized treasury payment should be gradually implemented.
Article 9 The collection, management and use of rural medical assistance funds, as well as the recipients and amount of assistance, shall be announced to the public through posting and news media on a regular basis and subject to social supervision. The rural medical assistance fund must be used for medical assistance to poor families in rural areas, and no unit or individual may intercept, occupy or misappropriate it. Civil affairs, finance, auditing and other departments shall regularly and irregularly supervise and inspect the use of rural medical assistance funds, correct problems in time when found, and report to the local people's government and relevant departments in time. The Ministry of Civil Affairs and the Ministry of Finance shall conduct spot checks on the use of medical assistance funds in various places as needed.
Tenth found false impersonator, misappropriation, corruption and waste and other violations, in accordance with relevant laws and regulations. Those who deliberately misrepresent relevant figures and information to defraud higher-level subsidies will be ordered to make immediate corrections, and the responsibilities of relevant units and personnel will be investigated according to the situation, and the higher-level subsidies will be reduced or stopped.
Eleventh localities can formulate specific measures for the collection, management and use of rural medical assistance funds according to the actual situation.
Article 12 These Measures shall be implemented as of the date of promulgation. The Ministry of Finance and the Ministry of Civil Affairs shall be responsible for the interpretation of these Provisions.
