The term "owners" as mentioned in these Regulations refers to the owners of residential properties.
The term "user" as mentioned in these Regulations refers to the lessee of residential property and other people who actually use the property.
The term "property management" as mentioned in these Regulations refers to the activities that the owners form the owners' committee and entrust the property management enterprises to manage some of their properties and the same affairs. Article 4 Property management shall follow the principle of combining owners' self-management with professional management services of property management enterprises.
Property management should develop towards socialization, specialization and marketization, improve service quality and improve living environment. Article 5 The real estate administrative department of the Municipal People's Government is the administrative department in charge of property management in this Municipality, and is responsible for the property management within the administrative area of this Municipality. According to the authorization of the municipal real estate administrative department, the district real estate administrative department is responsible for the property management within its jurisdiction.
The real estate administrative department of the county people's government shall be responsible for the property management within its administrative area under the guidance of the municipal real estate administrative department.
The relevant administrative departments shall, in accordance with their respective responsibilities, cooperate with the municipal and county real estate administrative departments to do a good job in the property management of residential quarters. Chapter II Owners' Autonomy Article 6 Under any of the following circumstances, the municipal or county real estate administrative department where the residential district is located shall supervise and guide it, and the residential selling unit shall organize the first owners' meeting or owners' congress within six months to elect the owners' committee:
(a) the residential area has delivered more than fifty percent of the construction area;
(two) the construction area of residential areas has reached more than 30% and less than 50%, and has been used for more than one year. Seventh owners' congress is composed of all owners of residential areas. If there are a large number of owners, the owners' representatives shall be elected in proportion to form the owners' assembly of residential quarters.
The owners' congress or the owners' congress shall exercise the following functions and powers:
(1) Electing and replacing members of the owners' committee;
(two) to formulate, amend and review the articles of association of the owners' committee and the owners' convention;
(three) to listen to and consider the work report and financial report of the owners' committee on property management services; Revoking inappropriate decisions of the owners' committee;
(four) to consider the use of * * residential parts, * * facilities and equipment maintenance fund;
(five) to decide on major issues of property management in residential quarters.
The owners' congress or the owners' congress shall invite representatives of the residents' committee and users at the location of the residential area to attend. Article 8 The owners' congress or owners' congress shall be held at least once a year to vote by voting. The residence is calculated according to the residence of each unit, that is, each household has one vote; Non-residential buildings have one vote per 100 square meter of construction area or per share. The owner's representative shall exercise the voting rights he represents.
Owners' congress or owners' congress must be attended by owners representing more than 50% of the voting rights. The owner may entrust an agent in writing to attend the owners' meeting or the owners' congress.
Upon the proposal of the owners representing more than 20% of the voting rights, an interim owners' meeting or owners' congress may be convened. The owners' committee shall convene an interim owners' meeting or owners' congress on the proposed topic within ten days after receiving the proposal.
The decision of the owners' congress or owners' congress shall be adopted by more than half of the voting rights held by the owners or owners' representatives present at the meeting. Article 9 The owners' committee is an organization that represents all owners of residential areas to implement autonomous management of property.
The owners' committee shall, within 15 days from the date of election, apply to the municipal or county real estate administrative department where the residential area is located with the application for registration of the establishment of the owners' committee, the articles of association of the owners' committee and the list of owners' committees.
City and county real estate administrative departments shall complete the registration within fifteen days from the date of accepting the application for registration, and make an announcement in the residential area. The registration date is the establishment date of the owners' committee. The owners' committee established in violation of these regulations shall not be registered, and the applicant shall be notified in writing. Article 10 The owners' committee shall be composed of five to fifteen people according to the scale of residential quarters, with an odd number. Members of the owners' committee shall be held by the owners or the users entrusted by them for a term of three years and may be re-elected.
The chairman and deputy directors of the owners' committee are elected from among the members of the owners' committee. Representatives of the owners who sell houses may be elected as members of the owners' committee, but they may not serve as directors or deputy directors of the owners' committee.
The meeting of the owners' committee shall be convened by the director, and the meeting must be attended by more than half of all members, and the decision shall be passed by more than half of all members and announced.
