Article 8 of the Trademark Law of the People's Republic of China
Any mark that can distinguish the goods of natural persons, legal persons or other organizations from those of others, including words, graphics, letters, numbers, three-dimensional marks, color combinations and sounds, and the combination of the above elements, can apply for registration as a trademark.
article 9
a trademark applied for registration shall have distinctive features and be easy to identify, and shall not conflict with the legal rights previously obtained by others.
a trademark registrant has the right to indicate a "registered trademark" or a registration mark.
Article 11
The following marks shall not be registered as trademarks:
(1) Only the common name, figure and model of the commodity;
(2) directly indicating the quality, main raw materials, function, use, weight, quantity and other characteristics of the goods;
(3) Other items lacking distinctive features.
the marks listed in the preceding paragraph can be registered as trademarks if they have been used to obtain distinctive features and are easy to identify.
