What are the registration conditions for sound trademarks in China?
According to Article 8 of the Trademark Law:

"Any sign that can distinguish the goods of natural persons, legal persons or other organizations from those of others, including words, graphics, letters, numbers, three-dimensional signs, color combinations and sounds, and the combination of the above elements, can apply for registration as a trademark."

The registration of sound as a trademark must meet the following important conditions:

1. Special sounds may not be recorded. For example, a voice with the same or similar melody as the national anthem or military song may not apply for registration as a trademark, and the voice may not contain words such as ethnic discrimination.

2. Do not damage the prior rights of others.

3. General and functional sounds may not be registered. For example, "Wedding March" cannot be registered as a sound trademark of the wedding service industry.

4. It must be significant. On May 4th, 20 14, Tencent Company filed an application to register QQ message "Didi Didi Didi" as a trademark, but the Trademark Office rejected the application on the grounds that "the applied trademark is composed of simple and common tones or melodies, which is not significant in the designated use items". Subsequently, Tencent filed a review application with the Trademark Review and Adjudication Board, and submitted relevant supporting materials, which was still rejected by the Trademark Review and Adjudication Board on the grounds that it was difficult to distinguish service sources.
