How to transfer a trademark and what are the procedures?

The trademark is a symbol of our goods and a necessity for entrepreneurs. When we no longer need to start a business or do not want to use this trademark and want to change it, we can transfer the trademark as long as we have a registration certificate and I am the owner of the trademark and are not prepared to continue using it. In addition to these reasons, there are some situations that need to transfer trademarks, such as inheritance and transfer.

notice of transfer

1. what are the procedures for purchasing the transferred registered trademark?

(1) The assignor and the assignee should sign an assignment agreement, after which the assignee can use the trademark. At the same time, the trademark can be used as a registered trademark, but the rights remain with the assignor. Because the transfer of a registered trademark requires approval and announcement, the transferee shall enjoy the exclusive right to use the trademark from the date of announcement.

(2) The transferee shall apply for the transfer of a registered trademark.

2. What information should be submitted when applying for the transfer of a registered trademark and how does the Trademark Law stipulate the transfer of trademarks?

(1) To transfer a registered trademark, the assignor and the assignee shall submit an application for transfer of the registered trademark to the Trademark Office (the assignor and the assignee affix their seals on the application for transfer), a copy of the trademark registration certificate, a copy of the business license or identity card of the assignor and the assignee, and a trademark agency power of attorney with the assignee's official seal if an agency is entrusted. The application procedures for the transfer of a registered trademark shall be handled by the transferee. After the Trademark Office approves the application for assignment of a registered trademark, it shall issue the corresponding certificate to the transferee.

(2) Where a registered trademark is transferred, the trademark transferor must transfer the same or similar trademark registered on the same or similar goods. If it is not transferred together, the Trademark Office shall notify it to make corrections within a time limit. If it fails to make corrections within the time limit, it shall be deemed as giving up the application for transferring the registered trademark, and the Trademark Office shall notify the applicant in writing. The Trademark Office shall not approve an application for assignment of a registered trademark that may cause misidentification, confusion or other adverse effects, and shall notify the applicant in writing and explain the reasons.

The following documents must be submitted to the Trademark Office for trademark transfer:

1. An Application for Trademark Transfer, which should be stamped with the seals of the applicant and the assignee;

2. the power of attorney for trademark transfer stamped by the transferee;

3. A copy of the transferee's Business License;

4. Pay the trademark transfer application and other fees as required;

5. If you entrust a professional organization to apply, you still need to pay some fees (the fees are fixed by the entrusting organization, and the fees stipulated by each company are different), you can ask the Trademark Agency Co., Ltd. for details.
