What is the review process for Israeli trademarks?

1. Applicant qualifications: Anyone who wants to have exclusive rights to a trademark can apply for trademark registration. Others other than the owner can be authorized to register as users. Although Israel implements the first-to-file principle, prior use of the trademark will be taken into account when disputing claims regarding the same trademark or confusingly similar trademarks.

(1) The applicant is an enterprise: a copy of the enterprise's business license;

(2) Application For individuals: Copy of applicant’s ID card/passport.

(3) Trademark agency power of attorney;

(4) Trademark registration application.

2. Registration Procedure: Review→Announcement→Registration

After a trademark application is submitted, the response time is approximately 2-4 weeks for formal review and substantive review (including relative reasons and Absolute reasons). After the trademark application is approved, if there are no reasons for rejection, the trademark application will be announced for a period of 3 months. The trademark opposition period is 3-8 weeks. If there is no objection or the objection is not established, the trademark will be registered. If the above procedures are successful, the registration time will be 16-18 months.

Validity and renewal of Israeli trademarks: Once the trademark owner obtains registration, he will have exclusive rights to the registered goods. In all legal proceedings related to a registered trademark, the registration of the trademark registrant will be prima facie evidence of the validity of the registration itself and subsequent transfers.

Trademark registration is valid for 7 years from the date of application. The renewal registration is valid for 14 years. The renewal application can be submitted within 3 months before the expiration date, or within 6 months after the expiration date, subject to the payment of a certain fine.
