Which text and graphics cannot be used as trademarks?

According to the provisions of Article 10 of the Trademark Law, the following graphics and words shall not be used as trademarks:

(1) The same as the country name, national flag, The national emblem, military flag, medals are the same or similar, as well as the name of a specific place where the central state agency is located or the name or figure of a landmark building. The national flag, national emblem, and military flag are symbols of the country and the military. Using them as trademarks will damage the dignity of the country and the military. The medal is a symbol of the country and the military's reward for outstanding figures. Using it as a trademark will undermine the honor of the medal. When used on goods, country names generally indicate the country of manufacture of the goods. According to the needs of international trade, goods participating in international trade should be marked with the real country of production. Therefore, using country names as trademarks loses seriousness on the one hand, and on the other hand It also fails to achieve the purpose of distinguishing producers.

(2) Identical or similar to the name, national flag or military flag of a foreign country, except with the consent of the government of that country. This provision is to safeguard the dignity of foreign countries and foreign military forces, and reflects the principle of "mutual respect" in international exchanges that our country has always adhered to.

(3) Identical or similar to the flag, emblem or name of an intergovernmental international organization, except with the consent of the organization or if it is not likely to mislead the public. The purpose of this provision is also to safeguard the dignity of international organizations and thereby the dignity of each member state.

(4) Is the same as or similar to the official mark or inspection mark indicating the implementation of control and guarantee, except for authorized ones.

(5) The same or similar names as the "Red Cross" and "Red Crescent" symbols. The Red Cross is a voluntary international rescue and relief organization that rescues the wounded in wartime and rescues victims in peacetime. Its symbol is the red cross graphic, while in Islamic areas the "red crescent" graphic with a red crescent moon on a white background is used. It is a common international practice to prohibit the trademarking of its logo or name. Its purpose is to ensure that the activities of the Red Cross organization are facilitated and that its humanitarian activities are not interfered with by commercial activities.

(6) Ethnically discriminatory. The equality of all ethnic groups is the basic principle of my country's ethnic policy. Using words or graphics with ethnic discrimination as a trademark seriously damages this principle and is of course not allowed.

(7) Exaggerated and deceptive propaganda. This is to protect the interests of consumers. Just imagine, when a manufacturer in Beijing uses "Laoshan" in its own mineral water, or a manufacturer in Qingdao uses "Baotu Spring" in its own beverages, can consumers avoid misunderstandings? Therefore, such words or Registration of graphics is prohibited, which is also an internationally accepted practice.
