Article 2 These Regulations shall apply to the construction of ecological civilization and related activities within the administrative region of this province. Article 3 The term “ecological civilization” as mentioned in these Regulations refers to the concept of respecting nature, complying with nature and protecting nature, in which people live in harmony with each other, harmonious development between people and nature, and people and society, a virtuous cycle, all-round development, and sustainability prosperous society.
The construction of ecological civilization as mentioned in these Regulations refers to various construction activities and related activities carried out to realize ecological civilization. Article 4 Economic construction, political construction, cultural construction, social construction and other activities within the administrative region of this province shall be coordinated with the construction of ecological civilization and shall not conflict with the requirements of ecological civilization construction. Article 5 The construction of ecological civilization adheres to the policy of giving priority to conservation, protection and natural restoration, and adheres to the principles of combining government guidance with social participation, combining regional differentiation with overall optimization, and combining market incentives with legal guarantees to realize resource Utilization efficiency is improved, pollutant production is reduced, economic and social development methods are reasonable, industrial structure is optimized, and ecosystem security is achieved. Article 6 The Provincial People's Government shall uniformly lead, organize, and coordinate the construction of ecological civilization in the province. The people's governments at or above the county level shall be responsible for the construction of ecological civilization in their respective administrative regions, and shall incorporate the construction of ecological civilization into national economic and social development plans and annual plans.
The ecological civilization construction agencies of the people's governments at or above the county level are specifically responsible for the guidance, coordination, supervision and management of ecological civilization construction in their respective administrative regions.
Relevant departments of the people's governments at or above the county level shall do a good job in the construction of ecological civilization in accordance with their respective responsibilities. Article 7: Encourage citizens, legal persons and other organizations to participate in the construction of ecological civilization, and ensure their rights to know, participate, express and supervise. Citizens, legal persons and other organizations have the right to report, complain and accuse behaviors that endanger the construction of ecological civilization. Article 8 People's governments at all levels shall strengthen the publicity of ecological civilization, popularize ecological civilization knowledge, and advocate ecological civilization by carrying out theme publicity activities such as World Earth Day, Environment Day, Wetland Day, Low Carbon Day, Water Saving Day, and National Energy Conservation Publicity Week. behavior and improve the ecological civilization awareness of the whole society.
June every year is the province’s ecological civilization publicity month. Article 9 People's governments at all levels shall commend and reward units and individuals that have made outstanding achievements in building ecological civilization. Chapter 2 Planning and Construction Article 10 The provincial people's government shall prepare an ecological civilization construction plan. The municipal, state and county-level people's governments may prepare an ecological civilization construction plan for their respective administrative regions based on the ecological civilization construction plan of the people's government at the higher level and submit it to the people's congress at the same level. The main content of the ecological civilization construction plan includes: the overall goal of ecological civilization construction, indicator system, key areas and key projects, key tasks, guarantee mechanisms and measures, etc.
The ecological civilization construction plan approved in accordance with the law may not be modified by any unit or individual without going through legal procedures. Article 11 The Provincial People's Government shall delineate ecological protection red lines based on the province's main functional area plan and ecological civilization construction plan and relevant technical specifications, determine the ecological protection red line areas, the upper limit of natural resource use, and the bottom line of environmental quality and safety, and announce them to the public.
The term “ecological protection red lines” as mentioned in these Regulations refers to the protection of natural ecological functions, environmental quality and safety, and the utilization of natural resources in order to maintain national and regional ecological security, sustainable economic and social development, and protect public health. Strictly protected spatial boundaries and management limits need to be implemented.
Ecological protection red line areas include prohibited development zones, concentrated contiguous high-quality cultivated land, public welfare woodlands, drinking water source protection areas and other key ecological functional areas, ecologically sensitive areas, ecologically fragile areas and other areas with important ecological protection value area.
When formulating or adjusting overall land use planning, urban and rural planning, environmental protection planning, forestland protection and utilization planning, soil and water conservation planning, etc., ecological protection red lines must be observed.
Citizens, legal persons and other organizations engaged in various activities in ecological protection red line areas must strictly abide by relevant requirements and maintain ecological security. Article 12 People’s governments at or above the county level shall compile an indicator system for ecological civilization construction.
The ecological civilization construction indicator system includes ecological security, ecological economy, ecological environment, ecological settlement, ecological culture, ecological system, etc. Article 13 People's governments at or above the county level shall gradually establish a natural ecological space planning system, delineate the development and control boundaries of production, living and ecological space, and implement use control.
People's governments at all levels should optimize the land use structure, establish a land space development and protection system, delineate farmland and forestland protection red lines, and use land resources economically and intensively. Article 14 Relevant departments of the people's governments at or above the county level shall, in accordance with the ecological civilization construction plan of the people's government at the same level or the people's government at the higher level, formulate plans for clean production, circular economy development, response to climate change, ecological agriculture and ecological forestry development, urban and rural green transportation construction, ecological Plans or action plans for tourism development, green buildings and green ecological urban development shall be submitted to the people's government at the same level for approval before implementation.
