There is no difference between a personal trademark and a corporate trademark. Whether it is a personal registration or a company registration, its trademark value and the degree of legal protection are the same. But there are differences in other aspects.
What is the difference between an individual and a company's registration
First, the stability is different
When the company's name or address or the company's legal person changes, the trademark should be changed accordingly; Personal identity cards are generally unchanged, and trademarks do not need to be changed, which is relatively stable.
2: Different ownership rights
The trademark in the name of the company belongs to the company, and the enterprise legal person or shareholders of the enterprise do not have exclusive rights to the registered trademark. If the company is cancelled, the trademark will be invalid, and the trademark belongs to the company's property and needs liquidation; Trademarks in the name of individuals only belong to individuals, and the establishment or cancellation of enterprises has no influence on trademark pairs.
III. Different materials to be provided
1. Providing registered trademarks in the name of the company:
① A copy of the license is stamped with the official seal;
② trademark design.
2. Providing registered trademarks in the name of individuals:
① Signature of a copy of the self-employed license;
② signature of a copy of an individual's (i.e., self-employed) ID card;
③ trademark design.
note: if you apply with individual industrial and commercial households, you don't need a personal ID card. In addition, foreign individuals from Hong Kong, Macao and Taiwan can apply for trademarks directly with their passports.
Fourth, the ownership control is different
1. The trademark registered in the name of the company should be determined by the company;
2. Trademarks registered in the name of individuals are relatively concentrated, and individuals enjoy the exclusive right to use and control the trademarks.
V: Trademark Inheritance
A trademark registered in an individual's name can be inherited to his children after several years;
before the company cancels, the trademark under the company's name must be transferred before it can be inherited to other people or organizations.
Different registration processes
1. The name of the trademark that an individual or enterprise needs to apply for and the category that needs to be registered are given to the trademark agent, who will evaluate the passing rate of the trademark, apply directly if the passing rate is high, rename the trademark if the passing rate is low, and then re-evaluate;
2. A copy of the business license of the enterprise shall be stamped with the official seal and submitted to the trademark agent in the form of a scanned copy. Individuals shall provide a scanned copy of the business license of individual industrial and commercial households and a scanned copy of their personal identity cards;
3. Sign the power of attorney for trademark agency with official seal or signature;
4. Pay the trademark application fee to the agent;
5. The agent submits an application for trademark registration;
6. You can get the notification of trademark application acceptance in about one month.
7. Enter the waiting time of about half a year. If the trademark registration passes the preliminary examination, it will enter the announcement. After the end of the 3-month announcement period, register the announcement and then issue the trademark certificate. In the end, the right to use this trademark will be owned by individuals or enterprises.
