The Bai family and Bai Xiang are not the same family. Baixiang Group Co., Ltd. is a large-scale national comprehensive food enterprise whose main business is the production and sales of instant noodles, spanning flour, noodles, vermicelli, pastries, beverages and planting. However, due to food packaging infringement, Baijia, a well-known food company in Sichuan, claimed 2.2 million yuan from Henan Baixiang.

The Henan Provincial High Court made the final approval: rejecting the appeal of Sichuan Baijia Food Co., Ltd. and immediately stopping using the "White Elephant" registered with Henan Zhenglong Food Co., Ltd. on the packaging of its instant vermicelli products. The trademark is similar to the "Baijia" logo. After the final judgment of infringement came into effect, Baijiafan's infringing products were still sold in large quantities and the court's final judgment was not fulfilled.

Approval results of Baijia and Baixiang

In response to Baixiang’s accusations, the Baijia denounced Baixiang, and Sichuan Baijia Food Co., Ltd. issued a “solemn statement” stating that the Baijia’s trademark infringement against Baixiang was only a certain LOGO. The wording is similar, not to mention that this similarity is still controversial. The purpose of Bai Xiang is obviously to drag the entire Bai family into the Yellow River.

The Bai family fans were dissatisfied and appealed to the Henan Provincial Higher People's Court. After a verification trial, the Henan Provincial Court made a judgment and once again determined that the Bai family fans had infringed the copyright. Relevant personnel of the Baijia Group said: Baixiang Group has filed a financial compensation lawsuit with the court, requiring Baijia fans to bear responsibility for the consequences caused by trademark infringement and malicious speculation and to provide financial compensation.
