Product Labeling Regulations

Article 1 is to further standardize product labeling, guide companies to correctly label products, clearly indicate product quality information, and protect the legal rights of companies, users, and consumers. Rights and interests, these regulations are formulated in accordance with the provisions of the "People's Republic of China and Domestic Product Quality Law" and other laws and regulations.

Article 2 The term “product identification” as mentioned in these regulations refers to the collective name for various representations used to identify products and their quality, quantity, features, characteristics and usage methods. Product identification can be expressed in words, symbols, numbers, patterns and other descriptions.

Article 3 The labeling of products produced and sold within the territory of the People’s Republic of China shall comply with these regulations. If laws, regulations, rules and mandatory national standards and industry standards have other provisions on the labeling of product labels, these provisions must be observed at the same time.

Article 4 Products should have labels. Naked food and other naked products that are difficult to attach labels due to product characteristics do not need to attach product labels.

Article 5 In addition to product usage instructions, product logos shall be marked on the product or product sales package. product or product sales packaging. If the maximum surface area of ??a product or product sales package is less than 10 square centimeters, only the product name and manufacturer's name may be marked on the product or product sales package; for products with a limited use period, the product or product packaging must also be marked with the production name. Date and safe use period or expiry date. Other identification contents specified in this regulation may be marked on other descriptions of the product.

Article 6 The text used for product identification shall be standardized Chinese. You can use Chinese Pinyin or foreign languages ??at the same time. Chinese Pinyin and foreign languages ??should be smaller than the corresponding Chinese. The font height of Chinese characters, numbers and letters used in product identification shall not be less than 1.8 mm.

Article 7 Product labels should be clear, firm and easy to identify.

Article 8 Product labels should include product names. The product name should indicate the true attributes of the product and meet the following requirements:

1. If national standards or industry standards have provisions on product names, the names specified by national standards or industry standards should be used;

2. If national standards or industry standards do not stipulate product names, common names or common names that will not cause misunderstanding and confusion among users and consumers should be used;

3. If marked as "unusual name" , "trademark name", a name specified in items (1) and (2) of this article shall be clearly marked on the same location.

Article 9 Product labels should include the name and address of the producer. The name and address of the producer should be registered and can bear the responsibility for product quality. Imported products do not need to be marked with the name and address of the original manufacturer, but the place of origin (country/region, the same below) of the product should be marked, as well as the name and address of the agent, importer or seller registered in China according to law. The origin of imported products is determined in accordance with the "Interim Provisions of the People's Republic of China and the Customs of the People's Republic of China on the Origin of Imported Goods".

If any of the following circumstances occurs, it shall be marked in accordance with the following provisions:

1. A group company or its subsidiary that independently bears legal responsibility in accordance with the law shall be responsible for the products produced by it. Mark their respective names and addresses;

2. A branch of a group company or a production base of a group company that cannot bear independent legal responsibility according to law may label the products produced by the group company and branch company or production base. The name and address of the base can also be marked with the name and address of the group company;

3. Enterprises that cooperate with each other in accordance with the contract or agreement but operate independently shall have Mark the names and addresses of the respective producers;

4. If the entrusted enterprise processes products for the client and is not responsible for external sales, the name and address of the client shall be marked on the product;

5. For foreign enterprises that have established offices in China, the products produced by them can be marked with the name and address of the office registered in China according to law.

Article 10 Qualified products produced domestically shall be accompanied by product quality inspection certificates.

Article 11 Products produced domestically and sold domestically shall be marked with the number of the national standard, industry standard, local standard or registered enterprise standard implemented by the enterprise.

Article 12 The measurement units used in product identification shall be legal measurement units.

Article 13 Products subject to production license management shall be marked with a valid production license mark and number.

Article 14 According to the characteristics and usage requirements of the product, it is necessary to indicate the product specifications, grade, quantity, net content, the name and content of the main adults contained, and other technical requirements, and they shall be marked accordingly. The labeling of net content shall comply with the requirements of the "Regulations on Supervision of Measurement of Quantitative Packaged Commodities".

Article 15 Products with a limited use period shall be marked with the production date and safe use period or expiration date. The date representation method should comply with national standards or use "year, month, day" representation. The production date and safe use period or expiration date should be printed on the product or the product's sales package.

Article 16 Products whose improper use may easily cause damage to the product itself or may endanger human health and personal and property safety shall have warning signs or Chinese warning instructions. For products that are highly toxic, radioactive, dangerous, fragile, afraid of pressure, need to be protected from moisture, cannot be inverted, and have other special requirements, their packaging should comply with the requirements stipulated in laws, regulations, and contracts, and should be marked with warning signs or Chinese warning instructions and storage instructions. Article 17 Products with complex performance, structure and usage methods that are difficult to install and use shall have detailed installation, maintenance and usage instructions in accordance with the national standards, industry standards and local standards for the product. .

Article 18 The origin of the product marked by the manufacturer should be true. The origin of products should be marked according to the geographical concept of administrative divisions. The place of origin mentioned in these regulations refers to the place where the product is finally made, processed or assembled. After the product is formed, if it undergoes auxiliary processing in another place, the place of origin shall be determined in accordance with the provisions of paragraph 2 of this article. If laws and administrative regulations have other provisions on the determination of the origin of products, such provisions shall prevail.

Article 19 For products that have obtained quality certification, the certification mark can be marked on the products produced within the validity period of the certification.

Article 20 Products that have obtained the famous title or famous mark recognized by the state can be marked with the famous title or famous mark. When marking the famous title or famous logo, the time of acquisition and validity period should be clearly indicated.

Article 21 The product barcode marked on the product identification shall be a valid product barcode.

Article 22 For products that are specially made by the manufacturer for users in accordance with the contract and are not directly for sale, the product identification may be marked in accordance with the requirements of the contract.

Article 23 The labels of goods sold by sellers shall comply with the provisions of these Measures.

Article 24 Producers and sellers shall not forge or impersonate the names and addresses of others; shall not forge the origin, production date and expiration date of products; shall not forge or impersonate production license marks, Product barcodes and quality marks such as certification marks, famous quality marks, and other quality certificates.

Article 25 The meanings of the following terms in this provision are:

1. Strange names refer to names that are not in accordance with conventional naming methods and are difficult for users and consumers to understand. The product name of the product is not recognized.

2. Trademark name refers to the product name named after the product’s trademark.

Article 26 The State Administration of Technical Supervision is responsible for the interpretation of these regulations.
