What are the identification factors of well-known trademarks?
The Paris Convention not only does not give a clear definition of well-known trademarks, but also does not stipulate the factors or standards for identifying well-known trademarks. Article16bis of TRIPS Agreement stipulates that whether a trademark is a well-known trademark should consider the degree of public awareness. Article 14 of China's Trademark Law and Article 3 of the Provisions on the Recognition and Protection of Well-known Trademarks stipulate that the following five factors should be considered in the recognition of well-known trademarks:

1, the awareness of the trademark by the relevant public;

2. The term of use of the trademark, including the use, registration, history and scope of the trademark;

3. The duration, degree and geographical scope of any publicity work of trademarks, including advertising and promotion activities, geographical scope, types of publicity media and advertising volume, etc. ;

4, the trademark as a well-known trademark protection records, including the protection of the trademark as a well-known trademark in China or other countries and regions;

5. Other factors that make a trademark famous include output, sales volume, sales revenue, profits and taxes, sales area, etc. The main commodities that have used the trademark in the past three years.
