Trademark agents need to meet the following conditions:

(1) Have full capacity for civil conduct;

(2) Be familiar with trademark law and related laws and regulations , have professional knowledge of trademark agency, and pass the corresponding qualification examination;

(3) Practice in a service agency registered to engage in trademark agency business and a law firm engaged in trademark agency business;

(4) Other conditions.

Article 84 of the "Regulations on the Implementation of the Trademark Law of the People's Republic of China"

The term "trademark agency" as mentioned in the Trademark Law includes: Service agencies engaged in trademark agency business and law firms engaged in trademark agency business registered with the industrial and commercial administration department.

Article 85

Trademark agency practitioners as mentioned in the Trademark Law refer to staff members engaged in trademark agency business in trademark agencies.

Trademark agency practitioners are not allowed to accept entrustment in their own name.
