What are the application qualification standards for trademark registration agencies?

How to apply for trademark agency qualifications: First, the applicant must submit the registration certificate from the industrial and commercial administration department or the judicial administrative department’s approval of the establishment of a law firm and keep a copy. The industrial and commercial administration department then reviews the application materials. Finally, if the conditions are met, the Trademark Office or the Trademark Review and Adjudication Board will publicly notify them and record them in their credit files.

Article 84 of the "Regulations on the Implementation of the Trademark Law of the People's Republic of China"

The term "trademark agency" as mentioned in the Trademark Law includes: Service agencies engaged in trademark agency business and law firms engaged in trademark agency business registered with the industrial and commercial administration department.

Trademark agencies that engage in trademark agency business under the jurisdiction of the Trademark Office and the Trademark Review and Adjudication Board shall file with the Trademark Office in accordance with the following provisions:

(1) Submit to the industrial and commercial administration department Registration certification document or certification document approved by the judicial administrative department for the establishment of a law firm and keep a copy;

(2) Submit basic information such as the name, address, person in charge, and contact information of the trademark agency;

(3) Submit the list and contact information of trademark agency practitioners.

The industrial and commercial administrative department shall establish a credit file for trademark agencies. If a trademark agency violates the provisions of the Trademark Law or these Regulations, the Trademark Office or the Trademark Review and Adjudication Board shall publicly notify it and record it in its credit file.
