What is purchasing agent? To put it simply, purchasing on behalf of others means asking others to help you buy products that are unavailable. As for infringement of trademark rights and interests, Article 52 of the Trademark Law stipulates that any of the following acts infringes upon the exclusive right to use a registered trademark:
(1) Without the permission of the trademark registrant, infringement of the exclusive right to use a registered trademark Using a trademark that is the same as or similar to its registered trademark on a certain product or similar product;
(2) Selling products that infringe the exclusive rights of a registered trademark;
(3) Counterfeiting or unauthorized use Producing other people’s registered trademarks or selling counterfeit or unauthorized registered trademarks;
(4) Changing the registered trademark without the consent of the trademark registrant and putting the goods with the replaced trademark back on the market;
(5) Causing other damage to others’ exclusive rights to registered trademarks.
It can be seen that purchasing on behalf of others is just an act of purchasing items and will not infringe on trademark rights. (When looking for someone to purchase on your behalf, you are all looking for genuine products, and most of the genuine products are well-known brands, so it is difficult to infringe on other people’s trademark rights, except of course if you buy fakes)
