Article 2 Any unit engaged in the installation, modification, repair and daily maintenance of elevators, hoisting machinery, passenger ropeways and large amusement facilities and other electromechanical special equipment (hereinafter collectively referred to as electromechanical special equipment) ( (hereinafter collectively referred to as the construction unit) must obtain the "Special Equipment Installation, Modification and Maintenance License" (hereinafter referred to as the "License") and engage in corresponding work within the scope of the license. This rule does not apply to the daily maintenance of hoisting machinery, passenger ropeways and large amusement facilities, as well as the installation of electromechanical special equipment that is a complete finished product such as mobile cranes and racing amusement facilities.

Special equipment manufacturing units engaged in the above construction shall also abide by the provisions of these rules.

Article 3 The three construction categories of installation, modification and maintenance of electromechanical special equipment are divided into several levels according to the type of equipment and its different technical parameters. For specific classification and grading methods, see the "Classification and Grading Table for Mechanical and Electrical Special Equipment Construction Units" (Appendix 1).

Article 4 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Quality Supervision, Inspection and Quarantine) is responsible for the unified management of the qualification licensing of electromechanical special equipment construction units nationwide. The General Administration of Quality Supervision, Inspection and Quarantine is responsible for the qualification licensing of installation and renovation construction units, except for passenger ropeway construction units and the units specified in Article 37 of these rules. The qualification licensing of other units is entrusted to the quality and technical supervision bureaus of provinces, autonomous regions, and municipalities directly under the Central Government (hereinafter The provincial bureau (hereinafter referred to as the provincial bureau) is responsible for management; the qualification license of maintenance construction units is managed by the provincial bureau where the construction unit is located or the prefecture-level quality and technical supervision bureau entrusted by it. Article 5 The evaluation agency (hereinafter referred to as the evaluation agency) that implements the license conditions of the application unit as stipulated in these rules shall be determined and announced by the special equipment safety supervision agency of the General Administration.

Chapter 2 Qualification Licensing Conditions

Article 6 The construction unit must have independent legal person qualifications, hold a valid business license, and the registered capital should be consistent with the application scope of construction. Article 7 The construction unit must have a fixed office space and contact number. Enterprises applying for transformation qualifications should also have factories and sites that meet their transformation business needs.

Article 8 The quality and quantity of construction unit personnel shall meet the following conditions:

(1) The legal representative or his authorized agent shall understand the laws, regulations, and laws related to special equipment. regulations and safety technical specifications, and is fully responsible for the quality and safety technical performance of the special equipment responsible for the corresponding construction. The authorized agent should have a written authorization letter from the legal representative, and should indicate the agency matters, authority, time limit, etc.;

(2) A technical person in charge should be appointed to be responsible for the tasks undertaken by the unit Technical review work in the construction of mechanical and electrical special equipment.

The technical person in charge should master the laws, regulations, rules, safety technical specifications and standards related to special equipment, and must not work part-time in other units;

(3) Sufficient management personnel should be equipped and corresponding quality management should be established The organization has a group of professional technicians, quality inspection personnel and technical workers who meet the needs of the application operation. Article 9: Equipment, tools, measuring instruments and inspection and testing instruments and equipment that meet the needs of the construction application shall be available. Article 10 The construction unit must establish a quality management system, formulate relevant management systems, and compile quality manuals, quality management system procedures, work instructions, etc. Management system documentation. The construction unit is responsible for special services such as civil engineering, lifting and scaffolding erection during construction, and can entrust it to units with corresponding capabilities and qualifications by signing a contract. During the qualification review of the construction unit, if the above-mentioned business is completed in the form of subcontracting, the construction unit's corresponding capabilities will only be assessed on the establishment and implementation of its system for controlling the work quality of the subcontracting unit.

Article 11 The construction performance of the construction unit shall meet the following requirements:

(1) The construction unit that applies for a qualification license for the first time and obtains the "Permit" shall, after obtaining the certificate, The construction performance within one year should meet the requirements of the "Annual Performance Requirements for the Assessment of Mechanical and Electrical Special Equipment Construction Units" (Annex 3, hereinafter referred to as the "Performance Requirements");

(2) Propose review and replacement of the "License" The construction performance in the previous year for which the license was applied for should meet the provisions of the "Performance Requirements";

(3) The construction performance after obtaining the "Permit" should meet the provisions of the "Basic Conditions".

Special equipment manufacturing units that only apply for relevant qualifications to undertake the construction of equipment manufactured by the unit with permission are not subject to the above performance restrictions.

Chapter 3 Qualification Licensing Procedures

Article 12 The qualification licensing procedures for construction units include: application, acceptance, appraisal and review, review and certification, and announcement.

Article 13 Application

If the applicant unit is deemed to meet the conditions specified in Chapter 2 of these rules after self-evaluation, it shall submit the following application materials to the local provincial special equipment safety supervision The agency or the municipal-level special equipment safety supervision agency entrusted by it (hereinafter collectively referred to as the accepting agency):

(1) A copy of the legal person business license of the applicant unit;

(2) "Application Form for Special Equipment Installation, Modification and Maintenance License" (hereinafter referred to as "Application Form");

(3) Quality manual of the applicant unit.

If the applicant unit has branches in provinces, autonomous regions, or municipalities other than the place of registration, if the branch independently bears legal responsibilities, the branch shall apply for relevant qualifications separately in the location where it is located; if the branch does not bear independent legal responsibilities, For legal liability, its special equipment construction qualifications should be applied to the acceptance agency in the place where its "legal person" is registered, and the review agency where the branch is located should be invited to review. The review of the corresponding qualifications of its "legal person" should be conducted at the same time. The review results should be obtained from the branch Opinions of the local provincial special equipment safety supervision agency. If a license is obtained, the "Permit" of its "legal person" should indicate the branch and the scope of the permitted construction category.

A manufacturing unit's application for a construction qualification license can be submitted at the same time as the manufacturing license application, or it can be submitted separately. If it is submitted at the same time as the manufacturing license application, the license conditions review shall be conducted together with the manufacturing license review in accordance with the provisions of these rules. If there are branches, the provisions of this article shall be followed.

The application for passenger ropeway construction qualification shall be submitted to the special equipment safety supervision agency of the General Administration after signing the opinions of the provincial special equipment safety supervision agency.

Article 14 Acceptance

After receiving the application materials, the acceptance agency shall process them in accordance with the following provisions within 15 working days:

( 1) In any of the following circumstances, a decision will be made not to accept the application, the reasons for rejection will be stated in writing and the applicant will be notified:

1. The application materials are incomplete or fail to meet the requirements of Chapter 2

2. The application materials are untrue and cannot meet the conditions stipulated in Chapter 2;

3. Before submitting this application, there has been a 20th party within two years. Units that fall under any of the nine conditions;

4. Units that are involved in legal proceedings or other judicial disputes that have a negative impact on the application of the "License" or are receiving relevant judicial restrictions and penalties;

5. Institutions engaged in type testing, supervisory inspection, periodic inspection or review of relevant special equipment.

(2) Any unit that does not fall into the above situation shall make a decision to accept the application, sign the opinion on accepting the application on the "Application Form", and notify the applicant unit.

The evaluation agency shall provide the applicant with evaluation guidelines and evaluation rules in a timely manner. The applicant unit can negotiate with the review agency to determine the on-site review time after passing the self-assessment, and must notify the provincial bureau special equipment safety supervision agency where the applicant unit is located of the on-site review time. The special equipment safety supervision agency of the provincial bureau can assign a special equipment safety inspector to the scene to supervise and evaluate the quality of the work.

(2) The on-site review shall be conducted by a review team formed by the review agency. The review team shall consist of more than 2 (including 2) reviewers and specially invited experts (if necessary) who have passed the assessment of the General Administration’s special equipment safety supervision agency. ), usually 3 to 5 people, and the on-site review time generally does not exceed 3 days.

(3) The review work includes the assessment and review of the basic conditions of the construction unit and the establishment and operation of the quality management system. The review status shall be recorded in detail. At the end of the on-site review by the review team, the first draft of the "Report on Appraisal of Licensing Conditions for Mechanical and Electrical Special Equipment Construction Units" (Annex 4, hereinafter referred to as the "Review Report") filled in with the review team's review opinions shall be issued to the applicant. The unit shall notify the applicant and ask the person present at the applicant unit to sign.

(4) Based on the review records and opinions of the review team, and with the approval of the person in charge, the review agency will give the review conclusion of the "Review Report". The review conclusions are divided into three categories: qualified, basically qualified and not qualified:

1. Qualified

If it meets the conditions and requirements of the applied construction category, it can be rated as Meet the conditions;

2. Basically meet the conditions

Basically meet the conditions and requirements of the construction category applied for. There are some problems in the basic conditions and quality management system. (6) If the review or re-evaluation concludes that the conditions are not met, the review agency shall report to the accepting agency within 10 working days after completing the on-site review.

(7) The review agency shall, within 15 working days after completing the on-site review, promptly summarize the "Application", review records, and the "Review Report" with the review conclusion signed, as well as the review results after rectification. The review record and the "Review Report" signed with the review conclusion (if re-examined) shall be submitted to the accepting agency.

For units that have obtained corresponding special equipment manufacturing licenses, the review of separate applications for "License" will focus on personnel certification, equipment, quality management systems, especially construction plan management and other conditions. The on-site review generally takes no more than 2 days.

Article 16 Review and Issuance of Certification

After receiving the appraisal records and "Assessment Report" and other appraisal and appraisal materials, the accepting agency shall conduct an examination in accordance with the provisions of these rules and conduct a review within 30 days A decision will be made within working days on whether to issue a License. Those who pass the review shall be issued a "Permit"; those who fail the review shall be dealt with in accordance with the following provisions:

(1) The working procedures of the review agency do not comply with the regulations, or the materials provided are incomplete due to the review agency's reasons , the corresponding review agency shall be instructed to re-examine after integrating the procedures or supplementing the materials within the prescribed time limit, and shall simultaneously notify the applicant unit in writing;

(2) The working procedures of the review agency comply with the regulations, and the application materials are untrue or If the conditions and requirements stipulated in these rules cannot be met, a decision will be made to deny permission and the reasons will be explained in writing to the applicant.

Article 17 The "License" containing installation or modification qualifications is issued by the State Administration of Quality Supervision, Inspection and Quarantine (including entrusting the provincial bureau to accept and review). The "License" with only maintenance qualifications is issued by the provincial bureau, using a certificate uniformly produced by the General Administration of Quality Supervision, Inspection and Quarantine, and must be numbered according to the method prescribed by the General Administration of Quality Supervision, Inspection and Quarantine's special equipment safety supervision agency.

The provincial bureau should submit a copy of the certificate issued by the bureau in the quarter before this report to the special equipment safety supervision agency of the General Administration within the first week of each quarter.

The accepting agency should establish a file management system for the issuing unit and save the "Application Form" and necessary witness materials. The review agency shall keep all relevant information on the review of licensing conditions.

Article 18 Announcement

The unit that has obtained the "Permit" and its permitted construction scope shall be announced by the licensing department.

Chapter 4 Assessment Institutions and Reviewers

Article 19 The evaluation institution shall be planned by the Special Equipment Safety Supervision Agency of the General Administration, proposed by the accepting agency, and determined and unified by the Special Equipment Safety Supervision Agency of the General Administration Announced to the public. The review agency should meet the following conditions:

(1) A corresponding professional national-level or provincial-level inspection and testing agency or a social organization registered with the national or provincial-level civil affairs department, with more than 10 years of corresponding professional work history, Have legal person qualifications;

(2) Not engage in business activities such as the design, manufacture, installation, modification, repair, sales and daily maintenance of elevators;

(3) ) Equip at least 5 full-time reviewers with reasonable professional configurations, and the experience of the reviewers should be suitable for the review business;

(4) Establish and maintain a quality management system for review work;

(5) Have fixed office space, communication equipment, and file storage and storage conditions;

(6) Have relevant laws, regulations, rules, safety technical specifications and standards and other information;

(7) There are a considerable number of companies (in principle, no less than 50) in the region that plan to apply.

Article 20 The reviewers shall be submitted by the review agency to the General Administration’s special equipment safety supervision agency for assessment, and must meet the following conditions:

(1) Master the relevant knowledge of electromechanical special equipment Laws, regulations, rules and safety technical specifications, familiar with relevant management, technology and product standards and construction processes;

(2) Have a bachelor's degree or above in electrical or mechanical majors and be a nationally recognized engineer Technical positions above, or have a college degree or above in electrical or mechanical majors and a nationally recognized senior engineer or above technical position, and have more than 5 years of relevant work experience in the design, manufacture, installation, modification, maintenance or inspection of relevant special equipment;

(3) Have good language and written expression skills;

(4) Abide by laws and regulations, adhere to principles, be objective and fair, seek truth from facts, and have a decent style;

(5) Be employed by a relevant review agency, not engage in business activities such as the design, manufacture, installation, modification, repair, sales, and routine maintenance of elevators for special electromechanical equipment, and be able to keep the business secrets of the reviewed unit.

Article 21 The review agency shall formulate review guidelines and review rules, and submit them to the General Administration’s special equipment safety supervision agency and the local acceptance agency for filing. The on-site review plan should be reported to the accepting agency in a timely manner, and the status of the annual review should be summarized in a timely manner and reported to the special equipment safety supervision agency of the General Administration and the local accepting agency before the end of January of the following year.

Article 22 When engaging in evaluation work, the evaluation agency shall consciously accept the supervision of the applicant unit and the special equipment safety supervision agencies at all levels, and shall strengthen the daily management of the hired evaluation personnel and establish the evaluation personnel Performance profile. Those who neglect their duties, lose their impartiality, or abuse their power for personal gain will be criticized, administratively sanctioned, or terminated depending on the severity of the circumstances. The processing results should be reported to the special equipment safety supervision agency of the General Administration in a timely manner.

Chapter 5 Supervision and Management

Article 23 When the certification unit engages in construction within the permitted scope, it shall strictly implement the following requirements:

(1) The installation, modification and maintenance of elevators must be carried out by the elevator manufacturing unit or the construction unit entrusted and agreed by it through the contract to obtain the license of these rules. The elevator manufacturing unit is responsible for quality issues related to elevator quality and safe operation. In the following circumstances, the corresponding regulations shall be implemented:

1. The manufacturing unit no longer has the manufacturing license qualification for the corresponding type of elevator, and the elevator ownership unit may choose a unit with corresponding qualifications to carry out the modification or repair of the elevator. , and the unit responsible for the modification or maintenance shall be responsible for the quality issues involved in the elevator quality and safe operation;

2. The manufacturing unit still has the manufacturing license qualification for the corresponding type of elevator, and the elevator ownership unit plans to choose to obtain it on its own If a unit with corresponding qualifications carries out elevator renovation, it must replace the product nameplate in accordance with the requirements of paragraph 8 of this article, and the elevator renovation unit shall be responsible for quality issues related to elevator quality and safe operation.

(2) Units that have obtained elevator maintenance qualifications can accept the entrustment of the ownership unit to undertake the daily maintenance of elevators, and must implement other payment requirements in this article.

(3) The installation or repair and daily elevator maintenance units shall sign relevant contracts or agreements with the corresponding special equipment manufacturing units to ensure that they receive necessary technical guidance, cooperation and supply of spare parts. If the manufacturing unit no longer has the manufacturing license qualification for the corresponding type of special equipment, the aforementioned requirements of this paragraph may no longer be fulfilled, and the unit responsible for the corresponding construction shall be responsible for ensuring that the equipment meets the requirements of the corresponding safety technical specifications and standards.

(4) The daily elevator maintenance unit must ensure that its own employees can arrive at the location of the elevator being maintained in a timely manner. The time limit for timely arrival is subject to the agreement between the two parties and should generally not exceed 1 hour.

(5) During the installation and transformation process, there should be no less than 2 workers on site holding the "Special Equipment Operator Certificate" for the corresponding operation project, and one of them should be appointed as the project leader. On-site safety The number of inspectors shall not be less than 1.

(6) During the maintenance and daily elevator maintenance and construction process, there must be no less than one operator on site holding the "Special Equipment Operator Certificate" for the corresponding operation item.

(7) Effective measures should be taken to eliminate potential safety hazards during construction, and on-site operations should be carried out in strict accordance with the construction plan prepared by the unit. When the construction plan really needs to be adjusted, the construction plan must be written and reviewed strictly , approved management system.

(8) For special equipment that has been modified without the authorization or consent of the manufacturing unit, the modification unit must replace the product nameplate of the special equipment and indicate the name of the unit and the date of modification on the product nameplate and quality certificate. and the unit's "License" number, etc.

(9) For special equipment that has been installed, modified, or majorly repaired, the construction unit must conduct strict self-inspections in accordance with the requirements of relevant safety technical specifications and standards. Construction units that are responsible for repair or maintenance of special equipment in use should also conduct self-inspections according to the following deadlines in accordance with the requirements of relevant safety technical specifications and standards:

1. Elevators, passenger ropeways, and large amusement facilities The period for tower cranes and lifts is 6 months;

2. The period for lifting machinery other than tower cranes and lifts is 1 year.

The classification of elevator renovation, major repairs, repairs, and daily maintenance construction categories shall be carried out in accordance with the "Elevator Construction Category Classification Table" (Appendix 5).

Article 24 During the validity period of the "License", the evidence collection unit shall report promptly when the following circumstances occur:

(1) Legal representative or authorized agent and mailing address of the unit . When the contact number is changed, it should be reported to the original acceptance agency for record in a timely manner by letter, fax or email or other effective means.

(2) When the name of the unit is changed, an application for certificate replacement should be submitted to the original acceptance agency and the following materials should be submitted:

1. Documents approved by the industrial and commercial administration department for the name change ( If it exists);

2. A copy of the new legal person business license;

3. The original "License";

4. Change of name of the evidence collection unit A new seal pattern (no photocopy allowed).

The original acceptance agency can issue a new "License" after verifying the above information. The validity period of the certificate and the scope of operation project permission remain unchanged, and the original certificate will be withdrawn by the original acceptance agency.

(3) When there are major changes in the registered capital, the number of professional and technical personnel and certified operators, the quality management system and other conditions specified in Chapter 2 of these rules, the original acceptance agency shall be reported in a timely manner to determine whether Re-examine the conditions for obtaining evidence.

Article 25 When the certification unit intends to increase the construction category or improve the construction level, it shall fill in the "Application Form" in accordance with the procedures stipulated in Chapter 3 and submit the application to the original acceptance agency. After corresponding review and acceptance After the agency passes the review, a new license will be issued, and the original "License" will be returned to the issuing agency.

The focus of improving the job level review is the construction performance assessment and the review of registered capital, number of personnel and other conditions. The on-site review generally does not exceed one day.

Article 26 The "License" is valid for 4 years. After the expiration of the validity period, units that intend to continue to engage in corresponding construction should submit an application for license renewal 6 months before the expiration of the "License". The license renewal application and review must be conducted in accordance with the provisions of Chapter 3. If you fail to apply within the time limit or fail to pass the certification review, you will lose the corresponding qualifications and your qualifications will be canceled by the original certification agency. The expired "License" shall be returned to the issuing agency.

Article 27 When applying for certificate renewal, in addition to the materials specified in Article 13, the construction unit shall also provide the following information:

(1) Work since obtaining the certificate Summary;

(2) Summary table of installation, modification and maintenance equipment since the certification was obtained;

(3) Quality accident handling situation;

(4) A copy of the original "License".

Article 28 In addition to being conducted in accordance with the provisions of Chapter 3, the review for renewal of certificates shall also focus on the following content:

(1) Whether there is any construction beyond the scope of the permit ;

(2) Implementation of relevant laws, regulations, rules, safety technical specifications and standards;

(3) Operation of the quality management system;

(4) Assess construction performance in accordance with the "Basic Conditions" and "Performance Requirements";

(5) Randomly check the quality of on-site work during installation, modification and maintenance;

(6) User service situation and user feedback handling situation;

(7) Whether there are any major quality incidents, etc.

Article 29 During the validity period of the "License", the licensing agency shall strengthen the supervision and management of the license collection units through irregular spot checks and other methods. If any of the following circumstances occurs, the license-issuing agency will cancel its "Permit":

(1) Construction beyond the scope of the "Permit";

(2) The construction quality is serious decline or are found not to meet the conditions stipulated in these rules through random inspections and re-examinations, and after rectification within a time limit (generally no more than 3 months), the inspection or review is still unqualified;

(3) Construction shall be carried out by it The special equipment later has the potential for serious accidents;

(4) Altering, forging, transferring, renting or selling the "License", and selling or illegally providing quality certificates to unqualified units;

(5) Major personal casualties or equipment accidents due to construction quality;

(6) The construction performance of the operating unit that obtained the "Permit" for the first time in the first year after obtaining the certificate failed to Meet the requirements of the "Performance Requirements";

(7) There are other violations of relevant national laws and regulations during the organization of construction and business activities, and the qualifications should be disqualified in accordance with the corresponding laws and regulations.

The canceled "License" must be returned to the original issuing agency. If the above-mentioned behavior violates relevant laws and regulations, the punishment shall be implemented in accordance with the corresponding laws and regulations.

Article 30 If the applicant has any objection to the review conclusion or the behavior of the review agency and reviewers, it may submit an appeal in writing to the accepting agency within 10 working days after the completion of the review work. After receiving the appeal letter, the accepting agency shall handle it within 20 working days and respond to the applicant unit with the processing results. If you still have objections to the handling conclusion, you may apply for administrative review in accordance with the relevant national administrative review regulations.

Article 31 If one of the following situations occurs during the evaluation work of the evaluation agency or evaluation personnel, and the situation is verified to be true, the special equipment safety supervision agency of the General Administration will take action against the violation of regulations according to the seriousness of the case. The evaluation institution or the evaluation institution shall instruct the evaluation institution to impose administrative sanctions on the corresponding evaluation personnel; those suspected of committing crimes shall be transferred to the judicial authorities:

(1) Intentionally issuing an untrue "Assessment Report";

(3) Leaking the business secrets of the reviewed unit;

Article 37 When the same unit applies for a "Special Equipment Manufacturing License" and a "License" stipulated in these rules at the same time, if the "Special Equipment Manufacturing License" it applies for is in accordance with the regulations, it shall be issued by the General Administration. When the special equipment safety supervision agency accepts the application, the special equipment safety supervision agency of the General Administration will uniformly accept all applications. When conducting an assessment, the assessment agency shall provide convenience for the simultaneous implementation of multiple permit condition assessments.

Article 38 The special equipment safety supervision agency of the General Administration is responsible for interpreting these rules.
